Proceedings of the Council of Maryland, 1696/7-98. 403 April the 1st 1698 Lib. X.
i'he Council again Sate & were present as Yesterdy p. 18 Mr Samuel Holdsworth of Calvert County Came & pre sented to the Board a Deputation from Mr Iohn George of Boston dated the 25th of January Anno 1697/8 appointing him to be Agent under him for all prizes in Maryland pro ducing also an Attested Copy of Commission Granted the said John George by the principal Commissioners for prizes to be their Agent for the Governmts of New England, New York, Pensylvania, Maryland & Virginia dated the 11th of May 1697 thereby Superceed a Commission formerly granted to peter Jennings Esqr both attested by a Notary Publick & Isaac Adington Esqr Secretary of New England & whereas there is a clause in the said Mr Georges Commission which speaks of great Concealments & Embezzlements being made of prize goods &ca brought into this province &ca his Ex cellency gives the Same Answer to that part as he did to a like Clause in Mr Jenning's Commission The Question being asked what the said M Holdsworth desired in this particular he makes Answer he desires Mr Jennings may be Ordered to render an Acct what Money or Goods he has rec'd by virtue of his Commission & that Wt Effects he has in hands relating to that matter may be paid to him Seing his Commission is now Superceeded Whereupon he was told that his Majestys Lawyers must determine that point Whereupon it is referred to his Majestys Lawyers to Consult & make their report thereof Mr Holdsworth leaves the dispute to the Clcrk of the Councils hands until the Lawyers make their Report A Commission of the peace for Caecil County being pre pared & perused it is Ordered that Mr Harris Name be raised p. 19 out & Mr William Frisby if upon his coming into the Countrey he remove into Caecil County be inserted in his Stead by the honble Iames Frisby Esqr hereunto Especially Authorised & appointed Ordered that the Court for hearing appeals & writts of Error set the 14th Instant April & that Collo Addison Collo Courts & Esqr Brooks be Summoned to be here His Excellency with the advice of this Board is pleased to Order the following Letter to be writt which he was pleased to Subscribe vizt Port of Annapolis April the 1698 Capt Oldson This is to acquaint you that with the Advice of his Majes tys honble Council it being thought fit for his Majestys Service
