The question then being, "Shall the previous question be
now put?"

It was sustained.

The question then recurring upon the amendment proposed
by Mr. Linthicum ;

It was rejected.

Mr. Devecmon proposed the following amendment:
Fifth line of 3rd section, after the words "applied by them,"
insert "and whenever and as often as the coal trade of the
said Chesapeake and Ohio Canal Company is injuriously af-
fected by a reduction of the rates of transportation on coal
by the Baltimore and Ohio Railroad, the President and Di-
rectors of the said Canal Company are hereby authorized and
required to reduce the rates of toll in a similar ratio, so as to
maintain its equality of advantage with the said Railroad
Company in the transportation of coal.

The following amendment, proposed by the Committee on
Ways and Means, viz :

In section 3, line 5, after the word "expenses" insert "in-
cluding all expenses incurred since the close of navigation in
the autumn of 1866.

In section 4, line twenty-eight, after the word " whatso-
ever" insert "unless in the judgment of the President and
Directors who may; from time to time, be elected under the
provisions of this Act, the said surplus or any part there-
of may be absolutely necessary for repairing extraordi-.
nary damages to said canal, or making improvements
thereto, or to its dams, locks or other works, in which
case it shall be the duty of the Treasurer of the State, with
the consent of the trustees of said bondholders, to pay to
said President and Directors, upon their requisition, out of
said surplus, such sums as they may have expended in such
extraordinary repairs or necessary improvements."

Mr. Brydon proposed the following amendment:

Section 7. And be it enacted, that until otherwise ordered
by the General Assembly, the President of the said Canal
Company and one of the directors other than those to be
nominated by the said trustees shall reside in Allegany
county.

Mr. Evans proposed the following amendment:
Strike out the enacting clause and insert the following as a
substitute for the bill:

That the Board of Public Works be authorized to sell the
Chesapeake and Ohio Canal to the highest bidder for not less
than six millions of dollars clear of all liens.
