such established road or way as not to impede the
passage or transportation of persons or property
along the same, or when it shall be necessary to
pass through the lands of individuals, to construct
proper wagon ways across the said road or roads,
from one part of his lands to the other; and when-
ever any road or roads may hereafter be authorized
to be made by the Legislature, when it may be
necessary to cross said railroad, the Company shall
make or cause to be made a proper and convenient
way for the said road to cross, the expenses of
which shall be paid as the Legislature may direct.

Damage for
injury.

Sec. 14. And be it enacted, That if any person
shall wilfully, by any means whatsoever, injure,
impair or destroy any part of said railroad or any
of the necessary buildings or works, vehicles or
machinery of said Company, every such person so
offending shall each of them, for every such of-
fence, forfeit and pay to the Company the actual
damages sustained, which may be recovered by
the Company as any other debt or damages, and
also be subject to indictment in the Circuit Court
of the said county, and upon conviction, be fined
or imprisoned, in the discretion of the court.

Sec. 15. And be it enacted, That this Act shall
take effect from the date of its passage.

CHAPTER 61.
AN ACT for the protection of Fish and Terra-
pins in the tributaries of the Potomac River,
lying in Saint Mary's County, and to regulate
the time and manner of catching and taking
Fish and Terrapins in that portion of the Poto-
mac River between Cobb Point, in Charles
County, and Point Lookout, in Saint Mary's
County.
SECTION 1. Be it enacted by the General Assembly
of Maryland, That it shall not be lawful for any
