leave to report that the vote cast by the Senate were in num-
ber, twenty-four.

The vote cast by the House of Delegates were in number,
eighty-six.

Of which number John Merryman received fifty-four votes.
Robert Fowler received thirty-one votes.
Joshua Vansant received sixteen votes.
William F. Pannell received nine votes.
We therefore respectfully report that neither of the nomi-
nees having received a majority of the votes cast, there is
therefore no election.

Mr. Merrick submitted the following message:

BY THE HOUSE OF DELEGATES,

January 18, 1870.
Gentlemen of the Senate ;

The House of Delegates propose to your Honorable Body,
that the two Houses, attended by their Clerks and Sergeants-
at-Arms, meet in the Hall of the House of Delegates, for the
purpose of conducting the election of State Treasurer. The
ballots of the members of each House to be collected by its
own tellers, and all ballots to be counted in the presence of
the two Houses by the tellers, and to be announced by the
respective presiding officers of the two Houses. The rules of
the House of Delegates, so far as applicable, to govern the
joint sessions, and the Speaker of the House of Delegates to
preside over the joint sessions with the President of the Sen-
ate on his right hand.

Which was read, assented to, and sent to the Senate.
Mr Wootton, submitted the following message ;

BY THE HOUSE OF DELEGATES

January 18, 1870.
Gentlemen of the Senate:

We respectfully ask leave to withdraw our message offer-
ing to go into a joint assembly for the election of Treasurer.
