                                LAWS OF MARYLAND.

shall be made, and the amount thereof paid to the parties respectively
interested, before the said commissioners, or a majority
of them, shall proceed to open the said road.

    By 1806, ch. 89, persons aggrieved by such valuation may apply to a justice of
the peace, &c.

Proviso.

    4.  AND BE IT ENACTED, That the said commissioners may appoint
one of their number as treasurer, and give him a certificate,
under their hands, of his appointment, who is hereby empowered to
collect and receive the money that may be subscribed, for the purpose
of paying the damages, labourers, and other necessary expenses,
of opening the said road, and such subscribers are hereby directed
to pay their several subscriptions to the treasurer appointed
as aforesaid; and if any subscriber shall neglect or refuse to pay
the amount of his subscription, the said treasurer may and is hereby
authorised to sue for, recover and receive the same, and the said
monies when recovered, shall be applied by the commissioners, or
a majority of them, for the purposes contemplated by this act; Provided
nevertheless,
that the said road shall not be laid out or opened
through any garden, orchard or meadow, without the consent of the
owner or owners thereof.

                                      CHAP. XLVII.
An Act for an addition to the Town of Rockville, in Montgomery
                            County.

Preamble.     WHEREAS Elizabeth Crabb of Montgomery county, hath by her
petition set forth, that her children, heirs of the late Jeremiah
Crabb, hold lands adjoining to the town of Rockville, in Montgomery
county, the value of which would be greatly enhanced by laying
off eight acres, part thereof, into lots; therefore,

&c.
    2.  BE IT ENACTED, by the General Assembly of Maryland, That
Thomas P. Wilson, Lewis Beall and Richard West, be and they 
are hereby appointed commissioners, and the said commissioners,
or a major part of them, be and they are hereby authorised and required,
at any time before the first day of November, eighteen
hundred and six, to cause eight acres of land, adjoining the town
aforesaid, or such part thereof as they may think necessary, to be
surveyed and laid out into lots, streets, lanes and alleys, at the 
proper cost and expense of the said Elizabeth Crabb, in such manner
as to the said commissioners, or a majority of them shall appear
convenient.
Vacancies how to
be filled.
    3.  AND BE IT ENACTED, If any of the commissioners shall die,    
refuse, neglect, or be rendered incapable to act, the remaining commissioner
or commissioners may appoint some other person in the
place of the person or persons who shall so die, refuse, neglect, or
be incapable to act.
Commissioners allowance.     4.  AND BE IT ENACTED, That each of the said commissioners shall
be allowed two dollars per day for each day they shall attend as
commissioners aforesaid, and that the surveyor shall be allowed two
dollars per day for each and every day he shall be employed for the
purpose aforesaid.

    5.  AND BE IT ENACTED, That the commissioners aforesaid, or a 
major part of them, shall, on or before the first day of March,
eighteen hundred and seven, cause a correct and accurate survey
