to be in the justices to admit or suspend attorneys, salvo jure corona,
but there is no other department of our State government to which such
a salvo can enure, the constitution having provided that the Governor shall
not under any pretense exercise any power or prerogative by virtue of any
law, statute or customs of England or Great Britain." Kilty's Rep. 225.
In the case of the State v. Johnston, 2 H. & McH. 160, it was determined
that every Court is the sole judge whether an applicant ought to be ad-
mitted, and an appeal by the then Attorney General from an order ad-
mitting Johnston to practice in Baltimore County Court was dismissed.
The legislation in the State on the subject is collected in the observations
made in the General Court in behalf of Johnston.
The 11th section of Art. 11 of the Code,2 (1719, ch. 4, sec. 2,) directs
the judges of the several Courts to observe the demeanor of all attorneys
practising the law before them, who shall use any indecent liberties to
the lessening of the grandeur and authority of their respective Courts, and
shall discountenance and punish the same according to the nature of the
offence, either by suspending such attorney from his practice perpetually
or for a time, or by fine at the discretion of the Court not exceeding fifty
dollars for any one offence.
The removal of attorneys has always been held to be a judicial act, see
Randall v. Brigham, 7 Wallace, S. C. 523.
