230 14 E. 3, STAT. 1, CAP. 10, CUSTODY OF GAOLS.
169 CAP. X.
Sheriffs shall have the keeping of Gaols. A Prisoner by Duress becom-
eth an Approver.

Item, in the Eight of the
Gaols, which were wont to
be in ward of the Sheriffs,
and annexed to their Baili-
wicks, it is assented and ac-
corded, that they shall be re-
joined to the Sheriffs, and the
Sheriffs shall have the Custo-
dy of the same Gaols, as before
this time they were wont to
have; (3) and that they shall
put in such Keepers for whom
they will answer. (4) And if
it happens that the Keeper of
the Prison, or Under Keeper,
by too great Duress of Impris-
onment, and by Pain, make
any Prisoner that he hath in
his Ward to become an Ap-
pellor against his Will, and
thereof be attainted, he shall
have Judgment of Life and
of Member. (5) And that
the King's Justices, before
whom such cases shall happen,
shall inquire the truth there-
of; (6) and if they find by
Inquest thereupon taken, that
any Keeper or Under Keeper
hath done the same, he shall
be thereof arraigned; and if
he be found guilty, he shall
have Judgment of Life and
Member, as afore is said.

solient estre en garde des vis-
contes & annexez a lour bail-
lies assentuz est & acordez qe
il8 soient rejointz a les viscou-
tes & eient les viscountes la
garde des dites gaoles come
avant ces houres soleient avoir
& y mettent tieux gardeins
pur queux ils voillent respon-
dre. Et sil aveigne qe gardeyn
du prisone ou soutz gardein
par trop graude durete de pris-
one & par peine face nul pris-
on qil eit en sa garde devenir
appellour contre son gree & de
ceo soit atteint eit mise de
vie & de membre. Et qe
justices Ie roi devant queux
tieu cas avendra enquergent
snr ce la verite & sils troessent
par enqueste sur ce prise qe
nul gardein ou southgardein
leit fait soit de ceo aresne &
sil soit trove coupable eit
mise de vie & de membrfr
