See Kilty's note on this Statute, Rep. 217; Act of Feb. 1777, ch. 20, and 1862, ch. 235, which amends Art. 30, sec. 202 1 of the Code, and the first section of which is substantially the same as the 3d and 4th branches of this Statute, the only parts of it which Kilty says were proper to be con- tinued; see also 1 Kent's Comm. 403 n. (c). The Act of Feb. 1777, ch. 20, sec. 2, provided that the crimes enumerated therein should receive the same construction, that had been given to such of the said crimes as were enumerated in the Statute of Edward 3, commonly called the Statute of Treasons.
