A STATUTE
OF P U R V E Y O K S,
Made Anno. 2.3 EDW. III. Stat. 5, and A. D. 1350.
CAP. II.
A Declaration which Offences shall be adjudged Treason.

Item. Whereas divers Opin-
ions have been before this
time in what case Treason
shall be said, and in what
not; (2) the King, at the Re-
quest of the Lords and of the
Commons, hath made a De-
claration in the manner as
hereafter followeth; that is to
say: or if a man do levy War
against our Lord the King in
171* his Realm, or be adher-
ent to the King's Enemies in
his Realm, giving to them Aid
and Comfort in the Realm, or
elsewhere, and 1 hereof be pro-
bably attainted of open Deed
by tile People of their Condi-
tion.

See Kilty's note on this Statute, Rep. 217; Act of Feb. 1777, ch. 20, and
1862, ch. 235, which amends Art. 30, sec. 202 1 of the Code, and the first
section of which is substantially the same as the 3d and 4th branches of
this Statute, the only parts of it which Kilty says were proper to be con-
tinued; see also 1 Kent's Comm. 403 n. (c). The Act of Feb. 1777, ch.
20, sec. 2, provided that the crimes enumerated therein should receive the
same construction, that had been given to such of the said crimes as were
enumerated in the Statute of Edward 3, commonly called the Statute of
Treasons. And the Act of Oct. 1777, ch. 20, sec. 29, provided, that no per-
