No Person shall be condemned without his Answer.

What sort of persons shall be Justices of Peace; and what Authority
they shall have.

Item, That no man of what
Estate or Condition that he
be, shall be put out of Land
or Tenement, nor taken, nor
imprisoned, nor disinherited,
nor put to Death, without be-
ing brought in answer by due
Process of the Law.

Kilty observes on this, p. 220 of his Report, that the long enjoyment of
a right may make people forget the origin of it, but this right (though
possibly included,) not being expressly mentioned in our declaration of
rights, it is proper that this Statute should be continued. This, with other
Statutes to a similar effect, is recited in the preamble to 16 Car. 1, c. 10,
the Act abolishing the Star-Chamber.
