act, then a justice of the peace of said town or

county shall be hereby empowered to appoint judges
|
|
|
sufficient to fill the vacancy or vacancies, and they
|
|
|
shall proceed to hold an election as before specified ;

and the judges shall keep the polls open at least

three consecutive hours, (said polls shall be open at

one o'clock P. M., and shall close at four o'clock

P. M.;) and the said judges shall cause to be re-

said election, and after the closing of the polls, shall

count the ballots, and announce the result, and make
|

and sign a certificate thereof, to be filed among the

records of the said corporation; and the burgess

and commissioners so elected, shall, as soon there-
|

after as convenient, qualify and serve until the first
|
|
|
Saturday in April, eighteen hundred and seventy-

seven, or until their successors are elected and qual-

ified; and the burgess and commissioners so elected

certificate of the justice administering the same, and

|

a failure to qualify within ten days after their elec-

tion, shall be deemed a refusal on the part of the

parties so failing, to accept the office to which he has
|
|
|
been elected.

|
SEC. 86. Be it enacted, That if the burgess, or any
|

shall be disqualified during the year for which they

have been elected; the commissioners may elect a
