5100 ARTICLE 23.

the Mayor and Council may charge for such franchise, easements or
privileges when granted, and may charge an annual rental upon any
franchise, easement or privilege for using the streets, highways and side-
walks of said City that hitherto has been granted or may hereafter be
granted; to regulate and license auctioneers who cry any public sales
within the corporate limits of the City; to regulate and control all offen-
sive trades, manufacture and traffic in offensive fertilizer or other com-
modities, within the City limits; to provide for the codification of all
ordinances which may have been or may hereafter be passed; and to abate-
by appropriate ordinance all nuisances in said City which are so defined
at common law by this Act or by laws of the State of Maryland, whether
the same be herein specifically named or not; and for the purpose of
carrying out the aforegoing powers and for the preservation of the cleanli-
ness, health, peace and good order of the community, and for the protec-
tion of the lives and property of the citizens, and to suppress, abate and
discontinue, or cause to be suppressed, abated or discontinued all nuisances
within the corporate and sanitary limits of said City, they may pass all
ordinances or by-laws from time to time necessary, and to insure the
observance of said ordinances in addition to the usual action of debt or
such other civil remedies as may exist in such cases by law for the re-
covery of the penalties thereto affixed, they may affix thereto such reason-
able fines as to them appear right, and in default of the payment of any
fine imposed, they may provide for the imprisonment of the offender in.
the City lock-up or County Jail.

294. The Mayor and Council of Salisbury shall have charge of all the
streets and alleys of the said City, but shall in no manner be responsible
for the maintenance or control of the five bridges.across the branches of
the Wicomico River, which shall be and remain under the control of the
County Commissioners of Wicomico County.

When any mill dam within the limits of the City of Salisbury has been
or shall be acquired as a public street or highway, and there is a flumeway
or passage for water from the dam to a mill, or other place where the
water power is used, on the opposite side of such street or highway,
such flumeway shall be constructed throughout the distance that it passes
through the said street in a safe and substantial manner, and the bridge
over the same shall be constructed in a safe and substantial manner, and
both shall be maintained in good and safe condition, by the owner of such
dam at his own. expense, and such owner shall be liable for any damage
or injuisy caused by the negligence of such owner in constructing or main-
taining the same. And the Mayor and Council of Salisbury may pass
ordinances for the enforcement of these provisions and provide appro-
priate fines and penalties for non-compliance therewith. And the owner
of any such dam, mill, or other place where such water power is used may
after one month's notice to the Mayor and Council, abandon such flume-
way by written notice delivered to the Clerk of Salisbury. After such
