the sale to be made by the nearest constable in the
|
|
|
|
|
neighborhood where said justice resides, the officer
|
|
|
|
|
thus authorized to make sale by this section to
|
|
|
|
|
advertise the same in some newspaper published in
|
|
|
|
|
Queen Anne's county for at least ten days before
|
|
|
|
|
the said sale of the said sink box, decoys, boats, guns
|
|
|
|
|
and other furniture thus seized, setting forth the
|
|
|
|
|
time, place and terms of said sale (which shall be
|
|
|
|
|
for cash only), and from the proceeds of said sale the
|

officer shall pay one half to the County Commis-
|

sioners of Queen Anne's county, for the use of public
|

|
|
|
|
roads, and the other half to those aiding and arrest-
|
|
|
|
|
ing those found guilty by the said justice, unless the
|
|
|
|
|
arrest is made by a commander of the State Fishery
|
|
|
|
|
Force, in which case the officer selling shall be paid
|
|
|
|
|
such fees as are usual in his general business of col-
|
|
|
|
|
lecting executions, and the balance to be paid to the
|
|
|
|
|
County Commissioners for the use of the public
|
|
|
|
|
schools of Queen Anne's county.
|
|
|
|
|
SEC. 11. And be it enacted, That should any per-
|
|
|
|
|
son resist any officer in making any arrest under the
|
|
|
|
|
provisions of this act, said person or persons, upon
conviction before any justice of the peace of Queen
|
Resisting offi-
cer.
|
|
|
|
Anne's county, shall be fined not less than fifty or
|
|
|
|
|
more than five hundred dollars, and stand committed
|
|
|
|
|
until said fine has been paid.
|
|
|
|
|
SEC. 12. And be it enacted, That any person or
|
|
|
|
|
persons convicted under any of the provisions of
|
|
|
|
|
this act shall have the right of appeal from the
|
|
|
|
|
decision of said justice to the Circuit Court of Queen
|
|
|
|
|
Anne's county ; provided the person or persons so
|
|
|
|
|
appealing shall give bond, with two sufficient secur-
|
|
|
|
|
ities to be approved by the justice trying the same,
|

in double the amount of the fine imposed (and
|
peal.

|
|
also of the value of the property seized in case he be
|
|
|
|
|
a non-resident), with conditions to prosecute such
|
|
|
|
|
appeal with effect to the circuit court at its next
|
|
|
|
|
session thereafter, and to pay the fine imposed, and
|
|
|
|
|
all costs attending such proceedings, in case judgment
|
|
|
|
|
shall be confirmed.

|
|
|
SEC. 13. And be it enacted, That the waters of
|
|
|
|
|
Queen Anne's county are hereby so construed that
