the said corporation, for the payment of the same; and upon said ap-
plication, the same proceedings shall be had between the parties, and
the same relief afforded, as between mortgagees and mortgagors
upon a bill filed for relief and sale.

May sell.

5. And be it enacted, That if the said trustees should judge
it to be for the interest of the said corporation to dispose, either at
public or private sale, of the whole or any part of their property, ex-
cepting the square of ground on which the Cathedral Church stands,
it shall be lawful for them so to do, on condition that the nett pro-
ceeds thereof be applied to the redemption of an equal amount of
the said funded loan.

CHAPTER 46.

An act for the benefit of Saint John's College.
Sec. 1. Be it enacted BY the General Assembly of Maryland,
That the visitors and governors of Saint John's college in this
state, or any seven or more of them, be, and they are hereby au-
thorised to propose a scheme or schemes of a lottery or lotteries,
for raising a sum of money not exceeding eighty thousand dollars,
and to sell such scheme or schemes to any persons whatsoever; and
the purchaser or purchasers thereof are hereby empowered to sell
and dispose of the tickets in the said lottery or lotteries, in the city
of Baltimore or any other part of this state, exclusive of any con-
trol over the same by the corporation of the city of Baltimore, any

tow or usage to the contrary notwithstanding; Provided, That the
purchaser or purchasers of such scheme or schemes, shall, before
the sale or disposal of any ticket or tickets in said lottery or lotte-
ries, give bond to the state of Maryland, in the penalty of one hun-
dred and sixty thousand dollars, to be approved by the governor
and council, conditioned that he or they will well and truly apply
so much of the money arising therefrom within twelve months af-
ter the drawing of the said lottery or lotteries shall commence, as
will satisfy the fortunate adventurers for prizes drawn by them,
and defray the necessary expenses incurred in the management
thereof.

Bond to be re-
corded.

2. And be it enacted, That the governor and council shall
lodge such bond in the clerk's office of Anne-Arundel county, there
to be recorded; and upon such bond, or an office copy thereof, suit
or suits may be commenced and prosecuted against the obligors
therein or any of them, or their or any of their legal representatives
for any breach or non-compliance within the conditions of the
same.

Exempt from
taxation.

, 3. And be it enacted, That the lottery or lotteries hereby au-
thorised, shall be excepted from the provisions of the act entitled,
"An act to regulate lotteries," and the several supplements thereto,
so far as the same impose or direct that a tax shall be paid on the
prizes to be drawn in the said lottery or lotteries, and as to the
time of drawing imposed by the said act.

Application of
funds—report.

4. And be it enacted, That the visitors and governors of
Saint John's college, shall, within one year after the sale of the
said scheme or schemes, apply the sum of money received therefor
to the benefit of the said college, and for other purposes connected
with the said institution, and shall make report thereof to the ge-
neral Assembly at the session next thereafter.
