Then was produced an Indenture from one John Givens wherein

the sd Givens bound himself for three years to Serve y^e fsd Matthews

for & in Consideracon of eleaven hundred pounds of tobacco Clothing

& accomodations w^ch sd Indenture had Sundry Assignments on y^e back

made obliterated & imperfect not legible yett Ambrose Londons

[sd hand] plainly to be read to two of the Assigments & Tho Walston to

the third, besides the sd London acknowledged to have recd y^e foresd

Serv^t of the Sd Matthews &ca. — Likewise the following lines

were p^rduced (viz) August the tenth 1695 . Then recd of Wm

Matthews Eleven hundred pounds of tobacco due to me by Condicon

for Servitude as Witness my hand    John J Givens

The totall proceedings being Considerated by the Wor^ll Court

doe give judgm^t agt the Dft for the sum declared for viz 1100^lbs =

pounds of tobacco & Cost alias Executio – – – –

of James Maynard late of this County decd was attached to answer

unto Peter Bodkin Merc^ht. of a plea of trespass of the Case. And where

upon the sd Peter p^r Sam Worthington his Attorney Complaineth that

the Said James in August in the year of o^r Lord 1693 & before at

Snow Hill within the Jurisdiction of this Court became indebted unto

the sd Peter in the Sum of nine hundred ninety eight pounds of tobacco

Porke & twelve hundred eighty three pounds of tobacco & two pounds

five shillings & one penny Current money of England it being

for Severall goods & Merchandizes to the sd James Sold & delivered

as p^r a p^rticular acco^t here in Court produced appears Now the sd James

being indebted in manner & forme as afd, did upon him Self assume

& faithfully promise that the afd Sums of Porke tobacco & money

he would well & truely Content pay & Satisfie when thereunto required

Nevertheless the sd James in his life time to the sd Peter the afd Sum

of Porke tobacco & money hath not paid, nor y^e sd Hannah Since the

decease of the sd James nor either of them though often thereunto

required to the damage of the sd Peter of 1996 lb of Pork & 2566 =

pounds lof tobacco & 4^£: 10^s: 2^d & thereupon he brings this Sute &ca.

And the Defend^t she Says ought to have had a Coppy of the acco^t Sent w^th

the Writt for what, of which she prayes a Non Sute Dent

And the Plaintiffe Sayes that the acco^t being delivered w^th the

  Declaracon Ought not Suffer a Non Sute upon it & puts him

   Self upon the Court , it being the usual practice of y^e Same
