Manchester                                      2261

WHEREAS, the Mayor and Council of the Town of Manchester are
cognizant of the fact that the present limitations of the penalties which
they can prescribe for the breaking of Ordinances of the Town are such
that there is no real and present detriment to the breaking of said Ordi-
nances; and WHEREAS, the Mayor and Council are further cognizant of
the need to increase the penalties so that punishment is commensurate
with the crime; and WHEREAS, the Mayor and Council therefore pro-
pose to amend the Charter of the Town of Manchester.

RESOLVED: That the Charter of the Town of Manchester be amended
by deleting the present paragraph entitled MISDEMEANORS [97—
Editor] and substituting the following paragraph:

MISDEMEANORS

Every act or omission which, by ordinance, is made a misdemeanor
under the authority of this charter, unless otherwise provided shall be
punishable upon conviction before any trial magistrate or in the circuit
court for the county within which the offense is committed by a fine not
exceeding Twenty-five Thousand Dollars ($25,000.00) or imprisonment
for not exceeding One Year, or both such fine and imprisonment, in the
discretion of the court or trial magistrate. The party aggrieved shall have
the right to appeal as is now provided under the general laws of the State.
Where the act or omission is of a continuing nature and is persisted in,
a conviction for one offense shall not be a bar to a conviction for a continua-
tion of the offense subsequent to the first or any succeeding conviction.

Resolution

Whereas, a petition has been presented to the Mayor and Council of
the Town of Manchester to enlarge the corporate boundaries of said Town
by the annexation of land west of, and contiguous to, the corporate limits
of said Town; and

Whereas, the Mayor, as President of the Council, has caused to be made
a verification of the signatures upon said petition and has ascertained
that the persons signing the petition represent all of the owners of the
area sought to be annexed there being no persons residing therein nor
registered voters in said area to be annexed.

It is, therefore, RESOLVED by the Mayor and Council of the Town
of Manchester that all of the land lying within the boundaries of the here-
inafter described tracts shall be annexed and become a part of the Town
of Manchester:

All those two tracts or parcels of land situate on Maryland State Route
No. 27 (Manchester Road), in the Sixth Election District of Carroll County,
Maryland, and according to a certificate of survey made by J. H. Rife,
Registered Surveyor, dated August 24, 1967, more particularly described
as follows:
