NOTICE SHALL SET FORTH THE NATURE OF THE CORREC-
TIONS REQUIRED AND THE TIME WITHIN SUCH CORREC-
TIONS SHALL BE MADE. IF THE CORRECTIONS ARE NOT
COMMENCED AND DILIGENTLY PURSUED WITHIN TEN (10)
DAYS OF DELIVERY OF SAID NOTICE, THE PERMITTEE
SHALL BE CONSIDERED IN DEFAULT OF HIS OBLIGATIONS
UNDER THIS SUBTITLE, AND THE DEPARTMENT OF IN-
SPECTIONS AND PERMITS SHALL IMMEDIATELY NOTIFY
THE PERMITTEE AND THE SURETY BY REGISTERED MAIL
THAT A DEFAULT HAS OCCURRED.
Subtitle 20, "Grading and Sediment Control"
Article VII Violations and Severability
Section 12-2039. VIOLATIONS.
(A) In addition to any civil remedies, at law or in equity
(including ex parte injunctive relief), any violation of this Subtitle
shall be a misdemeanor, punishable by a fine of not more than one
thousand dollars ($1,000.00) or six (6) months imprisonment for
each and every violation, or both fine and imprisonment, in the
discretion of the judge. Every day that said violation continues shall
be a separate offense.
(B) NO SUCH VIOLATION SHALL BE PROSECUTED
UNTIL AFTER ISSUANCE OF THE NOTICE REQUIRED BY
THE PROVISIONS OF SECTION 12-2038.
SECTION 3. And be it further enacted, That if any provision of
this Ordinance or the application thereof to any person or circum-
stances is held invalid for any reason, such invalidity shall not affect
the other provisions or any other application of this Ordinance which
can be given effect without the invalid provisions or application, and
to this end, all the provisions of this Ordinance are hereby declared
to be severable.
SECTION 4. AND BE IT FURTHER ENACTED, THAT UPON
THE ADOPTION OF ADDITIONAL SECTIONS OF THIS SUB-
TITLE, THE ARTICLES, HEADINGS, SECTIONS OR SUBSEC-
TIONS OF THIS ORDINANCE MAY BE RENUMBERED OR
REARRANGED TO ESTABLISH AN ORDERLY NUMBERING
SYSTEM FOR THE ENTIRE SUBTITLE AND TO CORRECT
CROSS REFERENCES (PROVIDED THAT NO CHANGES OTHER
THAN TYPOGRAPHICAL CORRECTIONS MAY BE MADE TO
THE LANGUAGE OR SUBSTANCE THEREOF).
Section 5. And be it further enacted, That this Ordinance shall
take effect forty-five (45) days from the date it becomes law.
