Section 13-325.6. Completion of Buildings Under Construction.
Any structure, the construction of which has been started pur-
suant to plans on file with the Department of Inspections and Per-
mits, for which a lawful building permit was issued before the effec-
tive date of this subtitle may be completed in accordance with said
plans, provided that such construction is diligently pursued.
Section 13-325.7. Existing Special Exceptions Deemed Conforming.
Unless otherwise provided, any lawful use prior to the adoption
of this subtitle, and which is classified as a special exception in its
respective district by this subtitle, shall be deemed a conforming
use subject to conformance with the requirements of said special
exception.
Section 13-325.8. Registration of Existing Nonconforming Uses.
(a) Upon determination by the Planning and Zoning Officer
that a use or structure lawfully in existence at the effective date of
this subtitle is not in conformity with the provisions thereof, the
owner shall, within sixty (60) days of receipt of written notice of
such findings, apply for registration as a lawful nonconforming use.
Such application shall include the following information :
(1) Location map, clearly showing location of tract within the
County.
(2) Metes and bounds description of said tract.
(3) Name of owner(s) and tenant(s) of said tract, and deed
reference.
(4) Site plan, fully dimensioned.
(5) Description of the activities carried on and the character
thereof.
(6) Date of inception of said activity.
(7) Description of the extent of said activity.
(B) Upon receipt of said application, the Office of Planning
and Zoning shall assign a registration number to the said non-
conformity. Failure to comply with this section shall create a rebut-
table presumption that said use is nonconforming and subject to the
provisions of this subtitle DISCONTINUED AND ABANDONED,
AND THE OFFICE OF PLANNING AND ZONING SHALL
SEND NOTICE BY REGISTERED MAIL TO THE OWNER OF
THE PROPERTY TO THE EFFECT THAT SAID NONCON-
FORMITY HAS BEEN PRESUMED ABANDONED OR DISCON-
TINUED.
(b) (C) Not less than once each year (or as required under
the schedule for discontinuance), the Office of Planning and Zoning
shall send a questionnaire to the persons who have registered such
nonconformity, inquiring as to the current status of such noncon-
