positioned that its indications may be accurately read
and the weighing or measuring operations observed from
some position which reasonably may be assumed by a
customer;
(9) Violate any provision of this title or
of any rule or regulation adopted under this title;
(9) Manipulate or in any manner render a
weight or measure to a [[State]] state calculated to
deceive or defraud anyone;
(19) Misrepresent a weight, measurement, or
count affecting any purchase, sale, award, or amounts
paid or charged for a service.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.

AN ACT concerning
Soft Shell Clams — Hydraulic Dredging Restrictions
FOR the purpose of eliminating the requirement of
surveillance at all times of an area that the
Department of Natural Resources opens or closes to
the catching of soft shell clams by hydraulic
dredge; authorizing the Department of Natural
Resources to open more than one area at any time to
hydraulic dredging; eliminating the size limitation
on an area that the Department of Natural Resources
may open to hydraulic clam dredging; and generally
relating to the opening and closing of soft shell
clam hydraulic dredging areas.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 4-1039 (a) and (b) of Article -
Natural Resources, of the Annotated Code of Maryland
(1974 Volume and 1975 Supplement) be and they are hereby
repealed and reenacted, with amendments, to read as
