SECRETARY. [[INVITATIONS TO BID SHALL BE CONFINED TO
SMALL BUSINESSES AND BIDS FROM OTHER BUSINESSES SHALL BE
REJECTED]] INVITATIONS TO BID SHALL BE SENT TO SMALL

BUSINESSES IN ADDITION TO REGULAR BIDDERS TO ESTABLISH A

REASONABLE PRICE RANGE COMMENSURATE WITH___CURRENT MARKET

CONDITIONS.         SUBJECT TO SUBSECTION (F) OF THIS SECTION,

THE PURCHASE, CONTRACT, OR EXPENDITURE OF FUNDS SHALL BE
AWARDED IN ACCORDANCE WITH THE RULES AND REGULATIONS FOR
PURCHASING ADOPTED BY THE SECRETARY.

(F)        [[[1) IF THE SECRETARY DETERMINES THAT

ACCEPTANCE OF THE BEST BID WILL RESULT IN THE PAYMENT OF
AN UNREASONABLE PRICE, THE SECRETARY SHALL REJECT ALL
BIDS AND WITHDRAW THE DESIGNATION OF SMALL BUSINESS
SET-ASIDE.

(2)         IF THE SECRETARY WITHDRAWS THE SMALL

BUSINESS SET-ASIDE DESIGNATION, HE SHALL NOTIFY EACH
BIDDER OF THE REASON WHY THE BIDS WERE REJECTED.
INVITATIONS TO BID CONTAINING THE SAME OR REWRITTEN
SPECIFICATIONS AND TERMS THEN SHALL BE REISSUED WITHOUT A
SMALL BUSINESS SET-ASIDE DESIGNATION.]] THE SECRETARY
SHALL ACCEPT THE LOWEST RESPONSIVE AND RESPONSIBLE BID
FROM A SMALL BUSINESS FOR A SMALL BUSINESS SET-ASIDE, IF

THE BID DOES NOT EXCEED 5 PERCENT OF THE BID RECEIVED

FROM THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER FOR THE
SMALL BUSINESS SET-ASIDE.

(G) [[THE SECRETARY SHALL KEEP RECORDS CONCERNING
THE AWARDING OF CONTRACTS TO SMALL BUSINESSES, INCLUDING
MINORITY BUSINESS ENTERPRISES, WHICH SHALL INCLUDE THE
TOTAL VALUE OF AWARDS MADE IN THE PRECEDING FISCAL YEAR
UNDER THE DESIGNATION OF SMALL BUSINESS SET-ASIDE AND THE
TOTAL VALUE OF AWARDS MADE TO MINORITY BUSINESS
ENTERPRISES.]] THE SECRETARY SHALL REPORT TWICE A YEAR

TO THE COMMITTEE ON ADMINISTRATIVE, EXECUTIVE AND

LEGISLATIVE REVIEW ABOUT THE OPERATION AND EFFECTIVENESS
OF THE SMALL BUSINESS SET-ASIDE PROGRAM.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
