Former Article 41, § 59E(c)(2), which required
the State agency to administer the certificate of
need program, is deleted as unnecessary in light
of § 19-113 of this subtitle.

Former Article 41, § 59F, which required health
care facilities to give requested information to
the State agency, is deleted as unnecessary in
light of subsection (c) of this section, which
enables the State agency to request and collect
that information from any person.

19-106. STATEWIDE HEALTH COORDINATING COUNCIL.

(A)  COUNCIL ESTABLISHED.

THERE IS A STATEWIDE HEALTH COORDINATING COUNCIL. THE
COUNCIL IS IN THE DEPARTMENT FOR BUDGETARY PURPOSES ONLY.

(B)  APPOINTMENT.

THE GOVERNOR SHALL APPOINT THE MEMBERS OF THE COUNCIL
IN ACCORDANCE WITH THE FEDERAL ACT.

(C)  GENERAL POWERS AND DUTIES.

(1)  THE COUNCIL MAY ACCEPT FEDERAL AND OTHER
FUNDS THAT ARE AVAILABLE TO CARRY OUT PART I OF THIS
SUBTITLE.

(2)  IN ADDITION TO THE DUTIES SET FORTH
ELSEWHERE IN PART I OF THIS SUBTITLE OR IN THE FEDERAL ACT,
THE COUNCIL SHALL:

(I) ADVISE THE STATE AGENCY ON CARRYING
