subject to the approval of the Commission. It is the intention
that the allocation shall be made in the approximate amount of 85
percent to the current year's overnight races and 15 percent not
to exceed 17 percent to the current year's stake races.
(6) [6.41] 9.16 percent of the regular mutuel pool
and [5.91] 8.16 percent of the multiple mutuel pool of all races
during the year shall be retained by the licensee from which 0.25
percent of both pools shall be paid by the licensee to the
Maryland Race Track Employees Pension Fund to be administered by
representatives of the licensee and the employees and from which
0.75 percent of both pools, in calendar years 1983 and 1984 only;
shall be allocated by the licensee, with the approval of the
thoroughbred racing board, solely to pay the cost of track
maintenance, physical improvements, personnel related expenses,
and to ensure the maintenance of proper living conditions in the
backstretch. [Effective January 1, 1985, the percent of the
mutuel pools retained by the licensee shall be 5.66 percent of
the regular mutuel pool and 5.16 percent of the multiple mutuel
pool from which 0.25 percent of both pools shall be paid by the
licensee to the Maryland Race Track Employees Pension Fund to be
administered by representatives of the licensee and the
employees.]
(H) FOR THE CALENDAR YEAR 1984 AND ALL SUBSEQUENT YEARS,
THE HALF-MILE DAYS OF RACING AWARDED UNDER THE PROVISIONS OF §
7(F) OF THIS ARTICLE ARE SUBJECT TO ALL OF THE ALLOCATIONS AND
DEDUCTIONS OF THIS SECTION APPLICABLE TO MILE RACING DAYS.
15.
(a) In addition to licensing racing, as hereinbefore
provided, the Racing Commission is authorized to issue licenses
to the following organizations: the Maryland State Fair and
Agricultural Society, Incorporated shall be permitted to conduct
a race meeting with betting privileges, not to exceed forty-two
(42) days in any calendar year. Eighteen of the days assigned to
the Maryland State Fair and Agricultural Society, Incorporated
may be withdrawn by the Commission if the licensee fails to
provide an improvement program prescribed by the Commission, but,
if these days are withdrawn, they shall not be awarded elsewhere.
The Agricultural and Mechanical Association of Washington County
and the Southern Maryland Agricultural Fair Association of Prince
George's County each shall be permitted to conduct a race meeting
with betting privileges, not to exceed eighteen days in any
calendar year. [Such meetings] THE MARYLAND STATE FAIR AND
AGRICULTURAL SOCIETY, INCORPORATED MEETING must be held in
connection with or for the benefit of bona fide county fairs or
agricultural exhibitions and be held in compliance with all the
provisions of this article.] The award of all dates shall
constitute a license and not a franchise.
(E) FOR CALENDAR YEAR 1984 AND ALL SUBSEQUENT YEARS, THE
COMMISSION MAY NOT AWARD ANY DAYS OF RACING UNDER THIS SECTION.
