(20)  PROMOTES THE SALE OF DEVICES, APPLIANCES, OR
GOODS TO A PATIENT SO AS TO EXPLOIT THE PATIENT FOR FINANCIAL
GAIN; OR

(21)  BEHAVES IMMORALLY IN THE PRACTICE OF
ELECTROLOGY.

A PERSON WHO ACTS IN GOOD FAITH AND WITHIN THE SCOPE OF THE
JURISDICTION OF THE BOARD IS NOT CIVILLY LIABLE FOR GIVING
INFORMATION TO THE BOARD OR OTHERWISE PARTICIPATING IN ITS
ACTIVITIES.

6-314.

The Board shall reinstate the license of an individual who
has failed to renew a mortician license for any reason if the
individual:

(1)  Requests that the Board reinstate the license;

(2)  Meets the appropriate renewal requirements of
this subtitle;

(3)  Pays to the Board [the current renewal fee
required by this subtitle] A REINSTATEMENT FEE SET BY THE BOARD;
and

(4)  Submits to the Board an affidavit stating that
the individual did not practice mortuary science in this State
while the license was expired.

6-315.

(a) Subject to the hearing provisions of § 6-316 of this
subtitle and except as to a funeral establishment license, the
Board may deny a license to any applicant, reprimand any
licensee, IMPOSE A PENALTY NOT EXCEEDING $5,000, PLACE ANY
LICENSEE ON PROBATION, or suspend or revoke any license if the
applicant or licensee:

(1)  Fraudulently or deceptively obtains or attempts
to obtain a license for the applicant or licensee or for another;

(2)  Fraudulently or deceptively uses a license;

(3)  Commits fraud or misrepresentation in the
practice of mortuary science;

(4)   Is convicted of or pleads guilty or nolo
contendere to a felony or to a crime involving moral turpitude,
whether or not any appeal or other proceeding is pending to have
the conviction or plea set aside;
