(C) THE BOARD SHALL ADOPT RULES AND REGULATIONS TO SET
STANDARDS FOR THE IMPOSITION OF PENALTIES UNDER THIS SECTION.

(D) THE BOARD SHALL PAY ANY PENALTY COLLECTED UNDER THIS
SECTION INTO THE GENERAL FUND OF THIS STATE.

[10-313.

(a)   If after a hearing under § 10-314 of this subtitle the
Board finds that there are grounds under § 10-312 of this
subtitle to suspend or revoke a license, the Board may impose a
penalty not exceeding $5,000:

(1)   Instead of suspending the license; or

(2)   In addition to suspending or revoking the
license.

(b)  The Board shall adopt rules and regulations to set
standards for the imposition of penalties under this section.

(c)  The Board shall pay any penalty collected under this
section into the General Fund of this State.]

12-207.

A PERSON WHO ACTS IN GOOD FAITH AND WITHIN THE SCOPE OF THE
JURISDICTION OF THE BOARD IS NOT CIVILLY LIABLE FOR GIVING
INFORMATION TO THE BOARD OR OTHERWISE PARTICIPATING IN ITS
ACTIVITIES.

12-311.

(a)   In this section, "convicted" includes a determination
of guilt, a guilty plea, or a plea of nolo contendere followed by
a sentence.

(b)  Subject to the hearing provisions of § 12-312 of this
subtitle, the Board, on the affirmative vote of a two-thirds
majority of its members then serving, may deny a license to any
applicant, reprimand any licensee, IMPOSE A PENALTY NOT EXCEEDING
$5,000, PLACE ANY LICENSEE ON PROBATION; or suspend or revoke a
license if the applicant or licensee:

(1)  Fraudulently or deceptively obtains or attempts
to obtain a license for the applicant or licensee or for another;

(2)  Fraudulently or deceptively uses a license;

(3)  Aids an unauthorized individual to practice
pharmacy or to represent that the individual is a pharmacist;

(4)  Provides professional services while:

(i) Under the influence of alcohol; or
