(14)   IS PROFESSIONALLY, PHYSICALLY, OR MENTALLY
INCOMPETENT;

(15)  PROMOTES THE SALE OF DEVICES, APPLIANCES, OR
GOODS TO A PATIENT SO AS TO EXPLOIT THE PATIENT FOR FINANCIAL
GAIN; OR

(16)  BEHAVES IMMORALLY IN THE PRACTICE OF PSYCHOLOGY.

(B) THE BOARD MAY IMPOSE THE MONETARY PENALTY UNDER THIS
SECTION SEPARATELY OR IN ADDITION TO A REPRIMAND, PROBATION,
SUSPENSION, OR REVOCATION.

(C) THE BOARD SHALL ADOPT RULES AND REGULATIONS TO SET
STANDARDS FOR THE IMPOSITION OF PENALTIES UNDER THIS SECTION.

(D) THE BOARD SHALL PAY ANY PENALTY COLLECTED UNDER THIS
SECTION INTO THE GENERAL FUND OF THIS STATE.

A PERSON WHO ACTS IN GOOD FAITH AND WITHIN THE SCOPE OF THE
JURISDICTION OF THE BOARD IS NOT CIVILLY LIABLE FOR GIVING
INFORMATION TO THE BOARD OR OTHERWISE PARTICIPATING IN ITS
ACTIVITIES.

The Board shall reinstate the certification of a registered
sanitarian who has failed to renew the certification for any
reason if the registered sanitarian:

(1)  Pays the Board all lapsed renewal fees; [or]

(2)  Reapplies and meets the qualifications and
requirements for certification[.]; OR

(3)  PAYS TO THE BOARD A REINSTATEMENT FEE SET BY THE
BOARD.

(a) Subject to the hearing provisions of § 17-315 of this
subtitle, the Board, on the affirmative vote of a majority of its
full authorized membership, may deny any applicant certification,

reprimand any individual certified, IMPOSE A PENALTY NOT

EXCEEDING $5,000, OR PLACE ANY INDIVIDUAL CERTIFIED ON PROBATION,
or suspend or revoke a certification, if the applicant or
individual certified:

(1) Fraudulently or deceptively obtains or attempts
to obtain a certificate for the applicant or certificate holder
or another;
