(II)  BOARD ACTIONS;

(III)  DISTRIBUTION OF FUNDS; AND

(IV)  SERVICE SUCCESS AND FAILURE.
137.

THE DEPARTMENT SHALL:

(1)  ADOPT RULES AND REGULATIONS TO DESIGN AND
ADMINISTER THE SHELTER, NUTRITION AND SERVICES PROGRAM. THE
DEPARTMENT SHALL SEEK THE ADVICE AND RECOMMENDATIONS OF THE BOARD
OF TRUSTEES IN DEVELOPING THESE RULES AND REGULATIONS;

(2)  CONTRACT WITH PUBLIC AND PRIVATE NONPROFIT
ORGANIZATIONS TO OPERATE THE PROGRAM;

(3)  THE DEPARTMENT SHALL SEEK THE RECOMMENDATIONS OF
THE BOARD IN REGARD TO POLICY DETERMINATIONS . , THE ALLOCATION
OF FUNDS AND THE DEVELOPMENT OF A PLAN FOR SERVING HOMELESS
INDIVIDUALS;

(4) ALLOCATE ANY AVAILABLE AND APPROPRIATE FEDERAL
AND STATE FUNDS FOR THE ESTABLISHMENT, ADMINISTRATION, AND
OPERATION OF SHELTER, NUTRITION, AND SERVICE PROGRAMS FOR
HOMELESS INDIVIDUALS; AND

(5) ALLOCATE FUNDS TO THE AREAS OF THE STATE WITH
CONSIDERATION TO UNMET NEEDS AND THE NUMBER OF HOMELESS
INDIVIDUALS IN THOSE AREAS.

Chapter 639 of the Acts of 1983

[SECTION 2. AND BE IT FURTHER ENACTED, That the termination
of the Shelter and Nutrition Program for Homeless Individuals
shall coincide with the termination of federal funding provided
by Public Law 98-8 or subsequent federal funding made available
to programs for the homeless, but not later than July 1, 1985,
without the necessity of further action by the General Assembly.]

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of
Maryland read as follows:

Article 81 - Revenue and Taxes

312.

(j) (1) Every individual, excluding, however, a fiduciary
or fiduciaries and the estates they represent, as defined in §
279(f) of this subtitle, or a merchant seaman who is in the
course of his employment out of the country for a substantial
indeterminate period during the calendar year and who has been
permitted a federal exemption for filing a declaration of
