of this section, the reference to "an affidavit under
oath" is substituted for the phrase "signed under the
penalties of perjury", for clarity.
Also in the introductory language of subsection (g)(3)
of this section, the former reference to the mortgage
instrument "offered for record" is deleted as
superfluous.
In subsection (i) of this section, the reference to a
"purchase money deed of trust" is added to conform to
current practice.
In the introductory language of subsection (k) of this
section, the defined term "security agreement" is
substituted for the former reference to a "filed
financing statement", for clarity.
In subsection (k)(4) of this section, the reference to
perfecting a security agreement "taken or retained by
a seller of collateral to secure all or part of its
price" is substituted for the former references to
"conditional sales contracts" and "purchase money
security agreements", for clarity.
In subsection (k)(5) of this section, the reference to
publicize "a lease of goods or fixtures provided that
the security agreement states on its face that it does
not create a security interest" is added to reflect
the present interpretation of the law.
In subsection (1) of this section, the words "of a
court" are added to modify "judgment", for clarity.
In the introductory language of subsection (p) of this
section, the defined term "instrument of writing" is
added for clarity.
In subsection (g) of this section, the words
"corporation or partnership" are substituted for the
former words "the entity involved", for clarity.
Also in subsection (q) of this section, the word
"stockholder" is substituted for the former word
"shareholder", for clarity. As to the use of
"stockholder" as a defined term, see CA § l-101(t).
In subsection (q)(2) of this section, the reference to
a direct descendant or relative within 2 degrees
"counting by the civil law method" is added to ET §
1-203. The General Assembly may wish to consider this
addition.
