in the violation, shall be guilty of a misdemeanor and upon
conviction thereof, shall be punishable by a fine of not more
than one thousand dollars ($1,000.00) or imprisonment for not
more than one (1) year or both fine and imprisonment.]

All moneys collected under this subheading shall be paid
over to the State Treasurer, and shall become general funds of
the State. Such moneys shall thereafter be disbursed by the
Comptroller only pursuant to an appropriation made in accordance
with §§ 32 and 52 of Article 3 of the Constitution or pursuant to
the provisions of §§ 1 through 15, inclusive, of Article 15A of
this Code, [title "Budget and Procurement,"] SUBTITLED "BUDGETARY
ADMINISTRATION", as amended from time to time. The secretary of
the Board shall, upon entering the performance of his duties, be
covered by a surety bond in accordance with the provisions of §§
46 through 50 of Article 78A of the Annotated Code of Maryland.

This subtitle does not apply to:

(4) The offer or sale of a business, which offer or
sale is regulated by the MARYLAND GASOHOL AND Gasoline Products
Marketing Act, Annotated Code of Maryland, Commercial Law
Article, Title 11, Subtitle 3, or the Petroleum Marketing
Practices Act, 15 U.S.C. 2801; or

The Governor, with the advice of the Secretary of Licensing
and Regulation, and with the advice and consent of the Senate,
shall appoint 9 persons to constitute the State Board of
Commissioners of Practical Plumbing [and] WHICH shall be a part
of the Department of Licensing and Regulation. The 9 member
Board shall be composed of 7 persons who are practical and
skilled plumbers and 2 public members. The 7 plumber members of
the Board shall be appointed as follows: Two shall be from
Baltimore City, one from Southern Maryland which includes a
geographical area of Anne Arundel, Calvert, Charles, Prince
George's and St. Mary's counties, one from the Eastern Shore
which includes a geographical area of Caroline, Dorchester, Kent,
Queen Anne's, Somerset, Talbot, Wicomico, and Worcester counties,
one from the area including Allegany, Washington, Garrett,
Frederick, and Montgomery counties and two from the area
including Carroll, Baltimore, Howard, Cecil, and Harford
counties, whose duty it shall be to faithfully and impartially
execute, or cause to be executed, all the provisions and
requirements of this subtitle. A public member of the Board may
not be a resident of the same city, county, or other political
subdivision of a plumber member of the Board. Any political
subdivision exempt from the provisions of this subtitle may not
have a member on the Board. The Governor, with the advice of the
Secretary of Licensing and Regulation, shall designate one of the
