(a) The recipient shall repay the State Scholarship
Administration the funds expended plus simple interest that is
equal to the prime rate plus 2 percent calculated from the date
of the 1st payment of the tuition assistance award under this
subtitle for any portion of the award not forgiven if the
recipient does not:
(2) Perform the service obligation for 1 year for
each year that the recipient has a tuition assistance award as
provided in [§ 18-1603(b)] § 18-1703(B) of this subtitle.
(b) (1) Subject to the provisions of [§ 18-1605(a)] §
18-1705(A) OF THIS SUBTITLE, the State Scholarship Administration
shall waive the repayment of the tuition assistance award in
physical or occupational therapy at the rate of 1 year for each
year that the recipient performs the service obligation.
(4) (ii) The State Scholarship Administration may
waive or defer repayment in the event of disability or extended
sickness which prevents the recipient from fulfilling the service
obligation required under [§ 18-1603] § 18-1703 OF THIS SUBTITLE.

Occurred: As a result of the concurrent codifications
of Chs. 246 and 697 of 1988, both of which added new
Subtitles 16 to Title 18. Ch. 697, which contained

18-1705.
(a) The repayment of the tuition assistance award in
physical or occupational therapy of a recipient who is not yet
required by the provisions of [§ 18-1604] § 18-1704 of this
subtitle to begin repayment of the award and who accepts
employment that fulfills the service obligation shall be
forgiven, for the purposes of [§ 18-1704] § 18-1704 OF THIS
SUBTITLE, at a rate of 1 year for each year that the recipient
performs the service obligation.
