STATE DEPARTMENT OF EDUCATION
HEADQUARTERS

The State Department of Education,
excluding positions authorized
under the corrections education
program 36.01.01.15, shall not
expend funds for any job or
position of employment approved
in this budget in excess of 1,326

1,329 positions, including

full-time equivalent, special
payments, contractual positions,
and temporary employment service
contractor positions (defined as
the quotient of the sum of the
days worked by all such employees
in the fiscal year divided by
245) of the total authorized
amount established in the budget
for the State Department of
Education at any one time during
fiscal year 1990. The State
Superintendent of Schools should
utilize his prerogatives under
the Education Article, Section

2-103, to implement this

provision, provided, however,
that any authorized job or
position to be filled above the
ceiling, including all 1,326

positions, as detailed above, is
approved by the Board of Public
Works and counted against the
limitation imposed by the General
Assembly. The establishment of
new jobs or positions not
authorized in the fiscal year
1990 budget shall be subject to
the State Finance and Procurement
Article, Section 7-236, and the
limitation imposed by the General
Assembly.
