(A)     (1) ANY PERSON WHO KNOWINGLY AND WILLFULLY VIOLATES THE
PROVISIONS OF THIS SUBTITLE IS GUILTY OF A MISDEMEANOR AND UPON
CONVICTION IS SUBJECT TO A FINE OF NOT MORE THAN $1,000 OR IMPRISONMENT
FOR NOT MORE THAN 1 YEAR OR BOTH.

(2) IF THE PERSON IS A BUSINESS ENTITY AND NOT A NATURAL
PERSON, EACH OFFICER AND PARTNER OF THE BUSINESS ENTITY WHO KNOWINGLY
AUTHORIZED OR PARTICIPATED IN THE VIOLATION IS GUILTY OF A MISDEMEANOR
AND UPON CONVICTION IS SUBJECT TO THE SAME PENALTIES AS THE BUSINESS
ENTITY.

(B)      (1) ANY PERSON WHO IS SUBJECT TO THE PROVISIONS OF THIS
SUBTITLE SHALL PRESERVE FOR 3 YEARS FROM THE DATE OF FILING THE
APPLICATION ALL ACCOUNTS, BILLS, RECEIPTS, BOOKS, PAPERS, AND DOCUMENTS
NECESSARY TO COMPLETE AND SUBSTANTIATE ANY REPORTS, STATEMENTS, OR
RECORDS REQUIRED TO BE MADE UNDER THIS SUBTITLE.

(2) THE PAPERS AND DOCUMENTS DESCRIBED IN PARAGRAPH (1) OF
THIS SUBSECTION SHALL BE AVAILABLE FOR INSPECTION UPON REQUEST TO THE
COMMISSION, AFTER REASONABLE NOTICE.

SECTION 2. AND BE IT FURTHER ENACTED, That if any provision of this Act
or the application thereof to any person or circumstance is held invalid for any reason in
a court of competent jurisdiction, the invalidity does not affect other provisions or any
other application of this Act which can be given effect without the invalid provision or
application, and for this purpose the provisions of this Act are declared severable.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall be construed
only prospectively and may not be applied or interpreted to have any effect on or
application to any action or event, including the making of contributions, that occurred
before the effective date of this Act.

SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994 January 1, 1995.

Dear President Miller:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 628.

Senate Bill 628 would authorize the sale of used vehicles that fail the State's safety
inspection by use of a "proof of inspection" certificate that lists the vehicle's safety
defects. The bill would also place responsibility for obtaining a safety inspection
