(D) THE DEPARTMENT MAY ADOPT REGULATIONS GOVERNING USE OF GILL
NETS FISHED UNDER THE PROVISIONS OF THIS SECTION IN ANY OF THE WATERS OF
THE STATE, RESTRICTING THE USE OF GILL NETS IN ANY WATERS DEEMED
NECESSARY FOR CONSERVATION PURPOSES, AND REGULATING THE QUANTITIES
OF ANY SPECIES OF FISH CAUGHT BY GILL NETS.
SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:
Article—Natural Resources
4-701.
(d) (1) The following annual license fees shall apply:
(iii) To catch finfish for personal consumption with a restricted gill net
pursuant to § 4-709 $25

(A) A person may be licensed to [utilize] USE a restricted gill net for
noncommercial fishing in the tidal waters of the State, [upon] ON application and
payment of [a] THE fee STATED IN § 4-701(D)(1)(III) OF THIS SUBTITLE.
(B) (1) The licensee may fish a single staked gill NET.
(2) THE GILL NET MAY NOT [net, not to] exceed [50] 100 yards in length
in the Chesapeake Bay and its tidal tributaries [and] OR 100 yards in length in the tidal
waters of Worcester County that are not tributaries of the Chesapeake BAY.
(3) [Bay and not to] THE GILL NET MAY NOT bo used for commercial
purposes.
(C) The use of nets fished under the provisions of this section is subject to every
law and every [rule or] regulation governing not fishing.
(D) The Department may adopt [rules and] regulations governing use of gill nets
fished under the provisions of this section in any of the waters of the State, restricting the
use of gill nets in any waters deemed necessary for conservation purposes, and regulating
the quantities of any species of fish caught by gill nets.
SECTION 3. AND BE IT FURTHER ENACTED, That Section 2 of this Act is
contingent on the taking effect of the termination provision specified in Section 5 of
Chapter 184 of the Acts of the General Assembly of 1994. If that termination provision
takes effect, Section 1 of this Act shall be void. This Act may not be interpreted to have
any effect on that termination provision.
SECTION 4. AND BE IT FURTHER ENACTED, That, notwithstanding any other
provision of law, and on payment of the appropriate fee, the Department of Natural
Resources shall issue a tidal fish license for restricted gill not fishing under § 4-709 of the
Natural Resources Article, as enacted by Section 1 of this Act, to any applicant who held
a license under § 4-709 of the Natural Resources Article at any time during the period
from September 1, 1993 through August 31, 1994.
