INCLUDING PROCEDURES THAT PROVIDE DUE PROCESS OF LAW TO EACH INMATE
BEFORE THE INMATE'S ACCOUNTS MAY BE CHARGED WITH A DISBURSEMENT UNDER
SUBSECTION (B) OF THIS SECTION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 678B.

Former Art. 27, § 678B(b)(2), which is revised in subsection (b)(2) of this
section, referred to "fees" assessed under former Art. 41, § 4-104. Under
former Art. 41, § 4-104(i), which is revised in § 2-118 of this article, the
Secretary of Public Safety and Correctional Services was required to assess
a reasonable fee, not to exceed $4.00, to cover the cost of certain medical
expenses. There were no other fees assessed under former Art. 41, § 4-104.
Therefore, subsection (b)(2) of this section refers only to § 2-118 of this
article and not to §§ 2-104, 2-107, and 2-109 through 2-115 of this article,
which are based on other provisions of former Art. 41, § 4-104. No
substantive change is intended.

In the introductory language of subsection (c) of this section, the former
reference to "rules" is deleted as unnecessary in light of the term
"regulations". See General Revisor's Note to this article.

SUBTITLE 7. DIMINUTION CREDITS.
3-701. "TERM OF CONFINEMENT" DEFINED.

IN THIS SUBTITLE, "TERM OF CONFINEMENT" MEANS:

(1) THE LENGTH OF THE SENTENCE, FOR A SINGLE SENTENCE; OR

(2) THE PERIOD FROM THE FIRST DAY OF THE SENTENCE THAT BEGINS
FIRST THROUGH THE LAST DAY OF THE SENTENCE THAT ENDS LAST, FOR:

(I) CONCURRENT SENTENCES;

(II) PARTIALLY CONCURRENT SENTENCES;

(III) CONSECUTIVE SENTENCES; OR

(IV) A COMBINATION OF CONCURRENT AND CONSECUTIVE

SENTENCES.
