REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 700A(c).

In subsection (a)(1) of this section, the defined term "Division" is
substituted for the former reference to "Department" for accuracy. See
General Revisor's Note to this subtitle.

Also in subsection (a)(1) of this section, the reference to "correctional
facilities" is substituted for the former reference to "facilities in the
institutions and camps" for consistency throughout this article and
because the reference to "camps" is obsolete. See § 1-101 of this article for
the definition of "correctional facility".

Also in subsection (a)(1) of this section, the reference to the Division's duty
to "adopt" facilities for the housing of inmates in the work-release program
is deleted as included in the broad reference to the Division's duty to
"designate" such facilities.

Also in subsection (a)(1) of this section, the reference to correctional
facilities "in" the Division is substituted for the former reference to
correctional facilities "under its jurisdiction" for consistency throughout
this article. See General Revisor's Note to this article.

In subsection (a)(2) of this section, the reference to a local "correctional"
facility is substituted for the former reference to a local "confinement"
facility for consistency throughout this article. See § 1-101 of this article
for the definition of "local correctional facility".

Also in subsection (a)(2) of this section, the reference to "hous[ing] ...
inmate [s]" is substituted for the former reference to "quartering ...
prisoner[s]" for consistency with subsection (a)(1) of this section.

3-804. SAME — DISPOSITION OF EARNINGS.

(A) SURRENDER TO DIVISION.

AN INMATE WHO IS EMPLOYED IN THE COMMUNITY UNDER A WORK-RELEASE
PLAN SHALL SURRENDER TO THE DIVISION THE INMATE'S TOTAL EARNINGS LESS
ANY PAYROLL DEDUCTIONS REQUIRED BY LAW.

(B) DEDUCTIONS.

(1) THE DIVISION SHALL DEDUCT FROM THE INMATE'S EARNINGS IN
THE FOLLOWING ORDER OF PRIORITY:

(I) AN AMOUNT THE DIVISION DETERMINES TO BE THE COST TO
THE STATE OF PROVIDING FOOD, LODGING, AND CLOTHING FOR THE INMATE;
