(I) ISSUE A WRITTEN AUTHORIZATION THAT:

1. SPECIFIES THE CONDITIONS OF THE COMPASSIONATE

LEAVE; AND

2. MAY BE CONDITIONED ON THE INMATE'S AGREEMENT TO
WAIVE THE RIGHT TO CONTEST EXTRADITION PROCEEDINGS; AND

(II) FILE A COPY OF THE AUTHORIZATION IN THE COMMISSIONER'S

OFFICE.

(2) WHILE ON COMPASSIONATE LEAVE, AN INMATE AT ALL TIMES
SHALL POSSESS A COPY OF THE AUTHORIZATION FOR COMPASSIONATE LEAVE.

(C) DURATION OF LEAVE; EXPENSES.

(1) THE DURATION OF COMPASSIONATE LEAVE SHALL INCLUDE
REASONABLE TIME:

(I) FOR TRAVEL; AND

(II) FOR FULFILLING THE PURPOSE OF THE LEAVE.

(2) THE COMMISSIONER MAY REQUIRE AN INMATE TO WHOM
COMPASSIONATE LEAVE IS GRANTED OR ANYONE ACTING ON THE INMATE'S BEHALF
TO REIMBURSE THE DIVISION FOR THE EXPENSES INCURRED BY THE DIVISION IN
GRANTING THE LEAVE.

(D) FAILURE TO COMPLY WITH AUTHORIZATION.

THE FAILURE OF AN INMATE TO COMPLY WITH THE TERMS OF THE INMATE'S
AUTHORIZATION FOR COMPASSIONATE LEAVE IS A VIOLATION OF ARTICLE 27, § 139
OF THE CODE.

(E) REGULATIONS.

THE COMMISSIONER MAY ADOPT REGULATIONS TO CARRY OUT THIS SECTION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 700B.

In subsection (a) of this section, the reference to "grant[ing]" leave is
substituted for the former reference to "authorizing]" leave for consistency
with subsections (b)(1) and (c)(2) of this section and §§ 3-801(b), 3-802(a)
and (b), 3-807(b), 3-809, 3-810(a), and 3-811(a) and (b)(1) of this subtitle.

In subsection (b)(l)(ii) of this section, the former requirement that a copy of
the authorization form be kept on file as a "public record" is deleted as
unnecessary in light of the laws governing public records that are set forth
in Title 10, Subtitle 6 of the State Government Article and for consistency
with §§ 3-810(c)(4) and 3-811(b)(1)(ii) of this subtitle.

In subsection (c)(2) of this section, the reference to- the defined term
"Division" is substituted for the former reference to the "Department of
