(C) REPORTS OF VIOLATIONS.

A MEMBER OF THE BOARD OF REVIEW, THE DIRECTOR, OR AN EMPLOYEE OF
THE INSTITUTION SHALL REPORT TO THE DIRECTOR OR THE SECRETARY ANY
VIOLATION OF SUBSECTION (A) OF THIS SECTION THAT IS WITHIN THE INDIVIDUAL'S
KNOWLEDGE.

(D) MISCONDUCT IN OFFICE; GROUNDS FOR REMOVAL.

(1) AN INDIVIDUAL WHO VIOLATES THIS SECTION IS GUILTY OF
MISCONDUCT IN OFFICE.

(2) A VIOLATION OF THIS SECTION IS GROUNDS FOR REMOVAL FROM
OFFICE OR EMPLOYMENT.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 31B, § 7.

In subsection (a)(1) of this section, the former reference to an individual
who is directly or indirectly "concerned" in any contract, purchase, or sale
is deleted as redundant of the reference to an individual who is directly or
indirectly "interested" in any contract, purchase, or sale and for
consistency with subsections (a)(2) and (b)(2) of this section.

In subsection (d)(1) of this section, the reference to an "individual... [being]
guilty of" misconduct in office is substituted for the former reference to a
"violation ... constitut[ing]" misconduct in office to state expressly that
which was only implied in the former law, i.e., an individual who violates
this section is guilty of the common law crime known as "misconduct in
office". See Chester v. State, 32 Md.App. 593, 363 A.2d 605 (1976).

THERE IS A CITIZENS ADVISORY BOARD.

(B) APPOINTMENT.

BASED ON RECOMMENDATIONS OF THE SECRETARY, THE GOVERNOR SHALL
APPOINT THE MEMBERS OF THE CITIZENS ADVISORY BOARD.

(C) DUTIES.
