2002 LAWS OF MARYLAND
2-105. In any judicial proceeding in which a local board is a party, the State Board: (1) [Shall be provided a copy of the proceedings by. certified mail,
immediately after the action has been filed] IMMEDIATELY AFTER THE ACTION HAS
BEEN FILED, SHALL BE PROVIDED BY CERTIFIED MAIL BY THE LOCAL BOARD WITH A
COPY OF THE COMPLAINT OR OTHER PLEADING THAT INITIATED THE PROCEEDING;
and (2) May join as a party to the proceeding. REVISOR'S NOTE: This section formerly was Art. 33, § 2-105. In item (1) of this section, the requirement that the "local board" provide
the State Board with a copy of the complaint or other pleading is added for
clarity. The only other changes are in style. Defined term: "State Board" § 1-101
2-106. (a) The State Board and each local board shall maintain and dispose of its
public records in accordance with the program for records management adopted by
the State Board under Title 10, Subtitle 6, Part IV of the State Government Article. (b) If produced and proved by a representative of the applicable board, a copy
of a public record that is certified by and kept under the seal of the principal
administrative officer of that board shall be evidence in any court to the same extent
as the original record. REVISOR'S NOTE: This section formerly was Art. 33, § 2-106. No changes are made. Subtitle 2. Local Boards. 2-201. (a) (1) There is a county board of elections in each county of the State. (2) Each local board and its staff is subject to the direction and authority
of the State Board and is accountable to the State Board for its actions in all matters
regarding the implementation of the requirements of this article and any applicable
federal law. (b) (1) Except as provided in subsection (j) of this section, each local board
consists of three regular members and two substitute members. (2) Two regular members and one substitute member shall be of the
majority party, and one regular member and one substitute member shall be of the
principal minority party.
