General Fund Appropriation, provided that
the amount appropriated herein for
Maryland Environmental Service critical
maintenance projects shall be transferred
to the appropriate State facility effective
July 1, 2004.................................................

Funds are appropriated in other agency
budgets and authorizations for capital
projects to pay for services provided by
this program. Authorization is hereby
granted to use an amount not to exceed
$2,000,000 of these receipts as special
funds for operating expenses in this
program provided, however, that
authorizations for capital projects may
not provide more than $1,500,000 for this
purpose.

DEPARTMENT OF TRANSPORTATION

It is the intent of the General Assembly that
projects and funding levels appropriated
for capital projects, as well as total
estimated project costs within the
Consolidated Transportation Program
(CTP), shall be expended in accordance
with the plan approved during the
legislative session. The department shall
prepare a report to notify the budget
committees of the proposed changes in the
event the department modifies the
program to:

(1) add a new project to the construction
program or development and
evaluation program meeting the
definition of a "major project" under
Section 2-103.1 of the

Transportation Article which was not
previously contained within a plan
reviewed in a prior year by the
