Report to Governor & General Assembly due Dec. 1, 2027 (Chapters 293 & 294, Acts of 2025).
In July 2025, the General Assembly required the Maryland Commission for Women of the Department of Human Services to establish the Maryland Collaborative to Advance Implementation of Coverage of Over–the–Counter Birth Control (Chapters 293 & 294, Acts of 2025).
To advance access to over–the–counter birth control, the Collaborative will study and make recommendations concerning: implementation of State coverage requirements for such birth control at pharmacies; and advancement of point–of–sale coverage options at retail counters, virtual retail platforms, and vending machines. The Collaborative also is to identify and evaluate public health initiatives to increase access to over–the–counter birth control for individuals without adequate coverage or access; and enhancement of education and engagement of consumers, health care practitioners, public health and community programs, and health care industry stakeholders.
Further, the Collaborative will consider responses to the request for information on over–the–counter coverage of preventive services published October 4, 2023, from the U.S. Department of Labor, the U.S. Department of the Treasury, and the U.S. Department of Health and Human Services; as well as the proposed rule on over–the–counter coverage issued by the U.S. Department of Health and Human Services, October 21, 2024. In addition, the Collaborative is to study other reports and materials on implementing coverage for over–the–counter birth ontrol, including “Free the Pill and Cover it Too: Strategies for Making OTC Coverage Work in the Real World”, Ibis Reproductive Health, (November 4, 2024), which was developed in consultation with policy experts in states with over–the–counter coverage laws.
Twenty members constitute the Collaborative. Fifteen are appointd by the Secretary of Human Services; two by the Secretary of Health, and one by the Secretary of Budget and Management. Also, one member each is appointed by the Executive Director of the Maryland Health Benefit Exchange, and the Maryland Insurance Commissioner.
Authorization for the Collaborative ends June 30, 2028.
