by the said Commiss^rs and by them returned, with other their Pro-
ceedings as before directed, into the County Court.
And be it likewise Enacted, That an Action may be brought in
the names of the said Commiss^rs on such Bonds, and in case of Judg-
ment, Execution issue to the use of the Person to whose use passed,
and that no such Action shall abate by the Death or Deaths of the
same Commiss^rs or Any of them, but that the Action shall proceed,
and Execution issue, as if such Commiss" were Actually living.
And be it Enacted by the Authority aforesaid, that where any
Creditor or Creditors of such person or persons so as aforesaid ab-
sconding, Runaway, Bankrupt, sloping or refusing Payment as
aforesaid, shall have good reason to believe, that any of the Effects
or Debts due to such Persons absconded, Runaway, Bankrupt, or
stoping or refusing payment as Aforesaid, are or shall be concealed
by any person or persons within this Province, that in such Case
it shall and may be lawful for such Creditor or Creditors to Apply
to the Commissioners aforesaid and give them notice thereof under
the Hand or Hands of such Creditors, with a List of the names of
such as they believe so concealing the Effects or Debts as aforesaid,
with an Account of what Effects or Debts, to the best of their
Knowledge, are so by them concealed: and the said Commiss^rs or
Any Two of them are hereby impowered, Authorized, and directed,
to procure such Debtor or Debtors to be examined, by way of Inter-
rogatories, upon Oath on the Holy Evangelis by any County Magis-
trate in the County where the said Debtor or Persons so concealing
as aforesaid respectively reside, or before A Provincial Magistrate
in such County: and in Case such Debtors or Persons shall refuse
to Appear, And Answer to such Interrogatories upon Oath, it shall
and may be lawful for such Magistrate to commit such Debtor or
person concealing and so refusing, until he shall comply by Answer-
ing upon oath as aforesaid. And in case such Debtor or person so
concealing as aforesaid shall wilfully swear or Affirm falsely such
person shall be liable to be punished, as in case of wilful and Corrupt
Perjury.
And be it Further Enacted, That all any every act or Acts of
Assembly now in Force, so far as relates to the manner of suing out
Attachments within this Province, shall be, and are hereby declared
to be repealed, and made null and Void. Provided always, that noth-
ing in this Act contained shall extend, or be construed to extend, tc
stop or hinder Any Person or Persons whatsover from proceeding
in all and every Action or Actions now depending, and founded or
the Act or Acts of Assembly, now in force, relating to the mannei
