forth and by sufficient Evidence made appear that Michael Curtis ;
and Sarah his Wife late of Saint Mary's County Deceased in Right
of which Sarah the said Michael was Seised of Saint Clements
Manner Bashford Manour and Westwood Manour lying and being
in Saint Mary's and Charles Countys and of Several other Lands
and Tenements lying in the said County of Saint Marys, Charles
and other Counties within this Province and Colony of Virginia
and Elsewhere Did for and in Consideration of the sum of Six hun-
dred Pounds Sterling by Indenture of Bargain and Sale bearing
date the Eighteenth day of May in Year of our Lord One Thousand
Seven hundred and Eleven Convey the said Manours and all other
the Manours Lands Tenements and Hereditaments whereunto the
said Michael or Sarah had any Right Title Claim or Interest unto
the said Charles Carroll deceased and his Heirs forever And whereas
the said Deed was acknowledged before a Provincial Magistrate by
Virtue of a Letter of Attorney the Execution of which Letter of
Attorney altho not before the time of such Acknowledgement is
now fully Proved and whereas also the Private Examination of the
said Sarah was taken by one County Justice only, which ought to
have been taken by a Provincial Justice or two County Justices ac-
cording to the Directions of an Act of Assembly Passed at a Session
of Assembly at the Town and Port of Annapolis the fifth day of
September in the Year one thousand Seven hundred & four enti-
tuled an Act for Quieting Possessions enrolling Conveyances &
Securing the Estates of Purchasers And Whereas it appears that
the said Deed was Enrolled within Six Months after the Execution
thereof according to the Direction of the said Act so that no fraud
can Possibly be supposed or imagined in obtaining the same Where-
fore in regard it clearly appears by incontestable Proof to this Gen-
eral Assembly that the before recited deed was Obtained fairly and
without the least Colour or Foundacon to suppose any instance of
Fraud Surprize or Circumvention And Whereas he the said Charles
Carroll hath Prayed this General Assembly that the same Leave and
Indulgence may be granted to him as has been usually done in like
Cases to others and that it may Be Enacted and be it Enacted by the
Right Honourable the Lord Proprietary by and with the Advice and
Consent of His Lordships Governour and the upper and Lower
Houses of this Present General Assembly and the Authority of the
same that the said herein Recited Indenture of Bargain & Sale shall
from henceforth and to all intents and Purposes be deemed and taken
to be Effectual and sufficient in the Law to Convey the said Manours
and Lands therein mentioned any Defect or Defects whatsoever
which may be in taking the Acknowledgment or Examination of
any of the Parties thereto according to the Directions of the said
Act of Assembly Passed in the Year of our Lord one Thousand
Seven hundred & four, or any other Matter or thing to the Contrary
in any wise notwithstanding, saving to His Lordship the Lord Pro-
