holders in the county aforesaid, not interested in the premises,
and qualified to serve as jurors in the county court, to appear
on a day to be by them appointed, on the premises ; and the
said commissioners, or any one of them, are hereby authorized
to administer an oath, or affirmation, as the case may be, to
every person so summoned, that he will, without favour, affec-
tion, partiality or prejudice, assess the damages sustained by
the person or persons at whose request such requisition shall be
taken, by transfer of his, her, or their lands, about to be made as
aforesaid, and by reason of the disadvantages attendant upon
the erection as aforesaid upon the land aforesaid, and the per-
sons so summoned and qualified shall thereupon proceed to
assess and value the damages accordingly, of which the said
commissioners, or any one of them, shall have given notice in
the public papers as aforesaid, and such inquisition shall be con-
clusive and final ; Provided, that in such appeal from the valua-
tion and assessment of damages made by the commissioners,
should the valuation and assessment of the said commissioners
be confirmed by the jury, by this act directed to be summoned,
the party appealing shall pay the whole expense incurred
thereby ; Provided, that the three lots on Concord Point, now
owned and used as a fishery by Joshua Green and Alexander
Myers, shall not be subject to condemnation for a garden.

SEC. 3. And be it enacted. That the right of jurisdiction of
the state of Maryland in and over the land aforesaid, be and the
same is hereby relinquished, ceded, and made over to the
United States aforesaid, for the purposes aforesaid, provided
that the quantity does not exceed one acre as aforesaid.

SEC. 6. And be it further enacted, That the right of jurisdic-
tion of the state of Maryland in and over the ground heretofore
contracted for, purchased, or to be purchased, by the United
States, as sites for the erection of a light-house and dwelling-
house, and so forth, on Cove Point, in Calvert county, be and
the same is hereby relinquished, ceded, and made over to the
United States, for the purposes aforesaid, provided the ground
so contracted for, purchased, or to be purchased, shall not ex-
ceed five acres.

SEC. 7. And be it enacted, That nothing herein contained
shall be taken or understood to prevent the authorized agent of
the United States from making a purchase of the property that
may be required for the establishment of said light-house,
dwelling and out-houses, and a garden patch.

SEC. 8. And be it enacted, That the property so purchased,
and not exceeding one acre, shall be ceded to the said United
States, in the same manner as if the commissioners had met,
valued and condemned the property.
The other sections omitted, are directory to the commissioners, and assess
