increase its capital stock three hundred thousand
dollars above its present capital, so as to make the
whole capital stock three hundred and thirty

Capital stock,

thousand dollars, in shares of twenty dollars each,
and if it should be found necessary, said Company
shall have the right and is hereby vested with the
power to raise money by means of a loan, and for
that purpose may mortgage the road, property
and franchises for any sum not exceeding two
hundred thousand dollars, and to issue bonds se-
cured by said mortgage payable at such time as
the stockholders of such Company may determine,
and bearing rates of interest conformable to the
laws of the State of Maryland; and said Company
shall be authorized to sell or dispose of said bonds
on any terms which the stockholder may deem ex-
pedient.

Not to impede
travel.

Sec. 7. And be it enacted, That whenever in
the construction of said road or roads it shall be
necessary to cross, intersect or use any highway,
street, or public or private road or avenue, it shall
be the duty of said Company so to construct said
railroad, turnpike road or roads, as not to impede
the passage or transportation of persons or proper-
ty along any such highway, street or avenue.

Rate.

Sec. 8. And be it enacted, That said Company
shall have power to charge for the transportation
of passengers not exceeding five cents per mile,
and the same sum for any distance less than a mile
for each passenger.

Damage,

Sec. 9. And be it enacted, That if any person or
persons shall wilfully break, injure or destroy the
railway, or any property belonging to the said
Company, or shall in any manner obstruct the free
passage along the said road, he, she or they shall
forfeit and pay to the said Company three times
the actual damage so sustained, to be sued for and
recovered, with cost of suit, before any Justice of
the Peace, or any court having cognizance thereof,
by action of debt, or on the case in the name and
for the use of the said Company.

In force.

Sec. 10. And be it enacted, That this Act shall
take effect from the date of its passage, and the
General Assembly reserves to itself the right to
amend, alter or annul this Act at pleasure.
