their violation, for the proper installation, security and protection of said
water and sewerage system; to make such extensions of said Water and
sewer system and fire protection service, or either, as may from time to
time appear necessary to them; and the said Mayor and Town Council
shall have power and authority, whenever said sewerage system shall be
in proper working order for receiving and disposing of sewage, to compel
the owner or owners of any building used or intended to be used as a
dwelling, or in which persons are employed or intended to be employed
in any manufacturing, trade or business, or any stable, shed, pen or place
where cows, horses, mules or other animals are kept, to connect the said
premises with said sewerage system, and to cause or require any sink,
cesspool or other receptacle of sewage on said premises to be cleaned out,
abandoned and filled up at the expense of the owner or owners thereof,
so as to prevent the further use of the same, the connection, and the re-
moval of all sinks, cesspools and other receptacle of sewage, to be done in
accordance with the ordinances of said Mayor and Town .Council having
relation thereto; if the owner or owners of such premises neglect or refuse
to make such connections and removals, as are required by the provisions
of this Act, the said Mayor and Town Council shall notify in writing,
the owner or owners of each and every premises to make said connections
and removals, and if the owner or owners of any such premises neglect
or refuse to make the same within thirty days after the receipt of said
notice, such owner or owners shall be deemed guilty of a misdemeanor
and shall, if convicted before the Mayor of the Town of Kensington, be
punished by a fine of not less than one dollar nor more than five dollars for
each day he, she or them fail or neglect to make such connections or re-
movals; if in case the owner or owners of said premises be a non-resident
or non-residents of the Town of Kensington, or cannot be found therein,
then, in that case, the said Mayor and Town Council shall give notice by
publication once a week for three successive weeks in some newspaper pub-
lished in the said County of Montgomery, to such owner or owners, direct-
ing the connection of such premises with the said sewerage system and the
removal of such sink, cesspool or other receptacle of sewage; provided,
however, that if the residence or place of abode of said non-resident owner
or owners be known, or can be ascertained on reasonable inquiry, then, and
in that case, a copy of the aforesaid notice shall be mailed to said non-
resident or non-residents in the proper name at said place of residence
or abode, legal postage prepaid; thereafter, in case such owner or owners
shall fail or neglect to comply with the notice aforesaid within thirty
days after the last publication and the date of the mailing of said written
notice, when the same is required, it shall be the duty of the Mayor and
Town Council to cause said connections and removals to be made, the cost
thereof, including the necessary expense of advertisement, to be assessed
as a tax against the real estate of said premises and to be collected in the
manner provided for the collection of other taxes to be levied under the
provisions of this Act.
