ROADS.
1865, c. 161 repeals section 108 and enacts the following in lieu thereof:

Gate owners on
public roads to
pay annual tax.
|
. 108. Any person having a gate on any of the pub-
lic roads in Queen Anne's county, shall pay annually
a tax of not less than two nor more than fifty dollars
for every such gate, in the discretion of the county
commissioners, and it is hereby made the duty of
said commissioners to publish for three successive
weeks, in two of the newspapers of largest circula-
tion in said county, a list of all the gates on the
public roads, together with the names of the owners,
and the amount of tax assessed on each, in parallel
columns, which said tax the owner will be required
to pay annually, so long as said gate shall continue
an obstruction to travel, and these taxes shall be
collected in manner provided for in the subsequent

sections of this article. In all cases where new roads
are laid down, and an appropriation made by the
county commissioners to pay the cost of fencing on
both sides of said road, or on one side when there in
already a fence on the other, there shall be no gate
allowed on said new road.
