SOMERSET COUNTY. [ART. 19.

1862, c. 74 adds the following sections:

Jurisdiction of
justices of the
peace.

66. The justices of the peace for Somerset county
shall have jurisdiction over, and may take cogni-
zance of actions of assault and battery, where the
damages claimed do not exceed the sum of one
hundred dollars, and also criminal jurisdiction in all
cases of assault and battery committed in said county,
unless it shall appear to the said justices of the peace,
upon the hearing of the case, that the said assault
and battery was committed with intent to kill.

Right of appeal.

67. In all cases hereafter tried under this act
before justices of the peace for said county, either
party shall be allowed an appeal to the circuit court
for Somerset county, where they shall be tried de
novo, and all such appeals shall be taken in such
manner as is now provided for by law, in other
cases of appeals from judgments of justices of the
peace.

LITTLE ANNAMESSEX RIVER.

1867, c 295 enacts the following:

be unobstruct-
ed.

68. It shall not be lawful to throw or put into the
navigable waters of the Little Annamessex river any
stone, earth, shells, timber or other substance tending
to fill up the said river or obstruct the navigation
between the railroad wharf and Tangier Sound, nor
shall it be lawful to, anchor or place any boat, vessel,
timber, rafts or floats of any kind in said river
between said points in the track of inward or out-
ward bound vessels, or to hinder and delay the
passage of any such vessels in or out; and any
person who shall be guilty of either of the offences

Penalty.

the discretion of the justice trying the same, to be
