plats now on file in the office of the County Com-


missioners of Baltimore county, the owner or


owners of any ground bounding and fronting on the


line of said avenue, may make application to the


County Commissioners of Baltimore county in


writing, setting forth that they desire that said Ful-


ton avenue be condemned, opened, graded and con-


structed, and when the application is presented to


said county commissioners, they shall appoint one


examiner or three examiners, as may be designated


and asked for in said petition, whose duty it


shall be to condemn, open, grade and construct said


avenue in accordance with said application and in


the manner hereinafter provided for.


SEC. 2. And be it enacted, That after the appoint-


ment of such examiner or examiners, as the case


may be, all proceedings which can be had and taken


for the condemnation, opening, grading and con-


struction of any street or avenue or portion thereof,

under the provisions of an Act of the General Assem-


bly of Maryland, passed at the January session of


eighteen hundred and seventy-six, chapter three


hundred and ninety-nine, entitled an act to repeal


an act passed at the January session of the General


Assembly, eighteeen hundred and seventy-four, chap-
ter four hundred and forty-one, entitled "An act to re-


peal an act, passed at the January session of the Gen-


eral Assembly of Maryland, eighteen hundred and

seventy," chapter ninety-nine, entitled "An act to lay


off streets in Baltimore county, adjoining Baltimore


city," and to repeal certain acts inconsistent there-


with, and also to repeal the act passed at the Janu-


ary session of eighteen hundred and seventy-two,


chapter seventy-eight, entitled an act, a supplement


to an act entitled "An act to lay off streets in Bal-


timore county, adjoining Baltimore city, and to re-


peal certain acts inconststent therewith by the Gen-


eral Assembly of Maryland at the January session


of eighteen hundred and seventy, chapter ninety-


nine," and also to repeal an act passed at the Janu-


ary session of eighteen hundred and seventy-two,


chapter three hundred and eighty-seven, entitled an


act to repeal section four of an act passed by the


General Assembly of Maryland at its January ses-


sion, eighteen hundred and seventy, chapter ninety-
