37 of Rakiawakin river aforesaid back in the woods from the Said river Called or knowne by the Name of Coxes Choice Containing & laid out for three hundred acres more or Lesse which Said Land was not made over & Confirmed according to law in the lifetime of the Said Cornelius Johnson to the Said William Wallis & his heires & assignes for Ever by reason y Pattent for the Said land was not returned out of the office but fell among other Lands unto William Jones party to these presents as pr will dated the 14th. day of febry 1686/7 doth & may appeare And the Said william Wallis for and in Consideration of Twelve thousand pounds of tobacco to him in hand paid by John ffreezell haveing assigned made over & released all his right Title Claime Interest & demand whatsoever to y Said Land aforesaid & pr:missell unto John ffreezell party to these presents & to his heires & assignes for Ever as pr release under his hand & Seale may appeare Now this Indenture witnesseth that the Said Wm: Jones ~ being privie to the Said bargaine & Contract made by his Testator Cornelius Johnson To and with the - Said william Wallis above mentioned and the Satisfaccon made for the Said Land hath for and in Consideration of ffive Shillings to him in hand paid at and before the ensealing & delivery hereof the recept whereof he doth hereby acknowledge & himselfe there wth is fully Satisfied hath granted bargained aliend & Sold And by these presents doth graunt bargain aliene & Sell unto the Said John ffreezell all that ~ Tract peece or parcell of Land Called or knowne by the name of Coxes Choice Scituate lyeing & being on the east Side of Chesepeake bay at the head of Rokiawakin river back in the woods from the river bounded as followeth beginning at a marke white oake Standing on the NorthSide of the Southeast branch of the Said river thence for the Southern bounds bounded downe the Said branch west for length five hundred thirty four perches thence with a Line drawne north into the woods for breadth ninety perches & from thence with a Lyne drawn paralell with the Said branch east ffive hunred thirty four perches & from thence with a right Lyne drawne to the first bounder Conteyning three hundred acres more or Lesse as pr Pattent dated y first day of September Annoq. Dom: 1687 doth & may at lardge appeare and the revertion and revertions remainder & remainders rents & yearly Proffitts whatsoever of all & Singular the Said pr:misses to every part and parcell ~ thereof Together with all & Singular Patents Deedes Evidences & writings Touching or Concerning only the pr:misses or any part thereof To have and to hold the Said Tract peice or parcell of Land Called Coxes Choice & all other the premisses & every part & parcell thereof with the appurtenances unto him the Said John ffreezell his heires and assignes for Ever unto the only proper use & behoofe of him the Said John ffreezell his heires & assignes for Ever & unto no other use intent & purpose wt:soever (Royall mines excepted) And the Said William Jones for him his heires executors & administrators doth Covenant promise & graunt to and with the Said John ffreezell his heires & assignes that he Said Wm: Jones now hath good right full power and Lawfull Authoritie to grant bargaine Sell alliene and Confirme the Said Tract or parcell of land Called Coxes Choice to him the Said John ffreezell his heires & asignes for Ever in Manner & forme aforesaid And that he the said John ffreezell his heires & assignes Shall or lawfully may from time to time and at all times hereafter by vertue of these pr:Sents (& undr: y rents & Services due to the Cheife Lord or Lords of the ffee or ffees of the Premisses for - In Respect of his or their Seignory or Segniorys only excepted and fore prized) peaceably & quietly have hold possess and enjoy the Said bargained mentmentioned or intended to be bargained Tract or parcell of all & Singular Land Called Coxes Choice & pr:misses & every part & parcell to the True intent & meaning of these presents ffree & ffreely acquitted exonerated and dischardged or otherwise well & sufficiently Saved & kept harmless by the Said William Jones his heires executrs: and assignes of and from all former & other guifts grants bargaines Seales feofements Mortgages leases Jointures Dowers rents arrerages of rents^ whatsoever had made done Comitted or Suffered or hereafter to be had made done Committed or Suffered by him the Said Wm: Jones Cornelius Johnson This Testator lately deceased or Daniell Jones Brother of the Said Wm: Jones (the Contract made by the Said Cornelius Johnson with William Wallis as abovesaid only excepted) or by any other person or persons Lawfully haveing or Claimes or to have or Claime by from wtth: or under him them or any of them And further he the Said Wm: Jones Shall & will from time to time and at ~ all times within Seaven years now next insueing the date hereof upon reasonable request (and) at the Proper Cost and Charges in the Lawe of him the Said John ffreezell his heires or assigne make doe acknowledge |
