( 111 ) Mr Francis Jenckins Plt Somerset County Ss // Peter Whaples late of Somerset County (otherwise Calld) Contra } Peter Whaples of Somerset County in ye Province of Maryland (Cordwainer was) Peter Whaples Defendt Sumond to answer unto ffrancis Jenckins of Somerset County Gent of a plea yt ~ ~ ~ ~ ~ ~ ~ ~ that he render unto him ye full & just Sum of twenty Six hundred Seventy & Nine pounds of good Sound Merchantable leaf tobacco which to him he oweth & unjustly deteineth. &ca. And whereupon ye sd ffrancis by Peter Dent his Attorney Compaineth that whereas the sd Peter the 20th day of May in the year of our Lord 1689 at Monocan within the Jurisdiction of this Court by his Certain Bill Obligitory wch the Said ffrancis with the Seal of the Said Peter Signed brings here into Court the date whereof is the day & year aforesd acknowledged himself to be indebted to the Said ffrancis in ye sd full & just Sum of 2679 Pounds of Tobacco to be pd to the Said ffrancis at Some One Towne or Port in the aforesd County at or upon ye tenth day of October next ensueing the date of the Said Bill to the which payment the Said Peter bound himself firmly by the Said Bill Nevertheless the Said Peter the Same to the Said ffrancis hath not rendered but hath hitherto refused and doth Still refuse to the damage of the Said ffrancis of 5000 Pounds of Tobacco and thereof he brings his Sute &ca Dent Pleg. Jno Doe Rich. Roe - - - - Vide Bill - - - - - This Bill bindeth me Peter Whaples of Somerset County in the Province of Maryland Cordwainer my Heirs Executors & Admrs to pay or Cause to be paid unto ffrancis Jenckins of Somerset County Gentl his Heirs Extors Admrs or Assigns the full & just Sum of twenty Six hundred Seventy nine pounds of good Sound Merchantable Leaf Tobacco in Caske Convenient at Some one Port or Towne in the aforesd County at or upon the tenth day of [October] next ensueing the date hereof as Witness my hand & Seal this [ ] day of May ano 1689 Testis// his Peter Whaples ❂ Sealed William W Woodland marke her Anne + Woodland marke The aforesd Declaracon & Bill being produced in Court with the Originall Writt agt Said Whaples at Sute of Sd Jenckins which sd Writt was returned Cepi Sciori fac pr me Martin Trontheim. The humble Petion of Richard: Tull & George Noble humbly Sheweth Whereas yr Petioners having [made] Preparation for Setting up of an Ordinary at Dividing creek and is daily making more Provision for Same hopeing thereby to become Serviceable to the County humbly Craves yr Worships would be pleased us Licence And yr Petioners as in duty bound Shall pray &ca. The aforesd Petion being read, it was Considered by the sd Justices and to the sd Tull only Granted to keep Ordinary as prayed . //
