upon himself and to the Said James then & their faithfully promise that he the Said Peter the Same to the said James

when requested would well & truely Content & pay Nevertheless the Said Peter his promise & Assumption aforesaid not

regarding, but minding & fraudulently intending him the Said James in this behalf to deceive the sd Sum of 1176 Pounds

of tobacco to the Said James hath not paid, although the Said Peter to doe the Same hath been thereunto requested but hath

hitherto refused, & doth Still refuse to the damage of the Said James of 2000 Pound of tobacco & thereof he brings his Sute

                pd to Garrett Vanswearing - - 253        by this Court Considered & Ordered that the sd Sheriff Should be amerced

                pd to mr Burrowes of St.Maries.223       according to Law for his false return & produce his prisoner next Court or

                                                to Porke 1176                                                                       pay the debt declared for when —

                pr 1 felt hatt. — 80                         proved with Cost alias Executio. And this day viz the 13th. of 7ber 1694

                                                                                the foresd Debt of 1176 lb &ca. was by the Oath of mr James Round in

                                                                                Open Court proved to be justly due & the aforesd Court Confirms the same afd

Peter: Dent. Plt Somerset County // Ss. Peter Whaples late of Somerset County was attached to answer unto

Peter.Whaples Dft}     Peter Dent of the Same County of a plea of trespas on the Case &ca. _____________

~ ~ ~ ~ ~ ~ And whereupon the Said Peter Dent in his Propper Person Complaineth that whereas the sd

Peter Whaples the 10th day of June in the year of or Lord 1691. at Monocan within the Jurisdiction of this County was

indebted to the Said Peter Dent in the Sum of two hundred Pounds of tobacco & two paire of Mens french fall Shoes

as by a perticular account thereof here in Court Produced may appear And the Said Peter Whaples to the sd Peter Dent

in manner aforesd being indebted did assume upon himself & to the Said Peter Dent then & there faithfully promise yt

he the Said Peter Whaples the Same to the sd Peter Dent when requested would well & truely Content & pay Nevertheless

the Said Peter Whaples his promise & assumption aforesd not regarding but minding & fraudulently intending the Said

Peter Dent in this behalf to deceive & defraud the Said Two hundred Pounds of tobacco & two paire of Mens french

fall Shoes to the Said Peter Dent hath not paid but hath hitherto refused & doth Still refuse to the damage of the sd Peter

Dent of 800 Pounds of tobacco & thereof he brings this Sute                                Jno Doe

The foresd Decl being produced & Read. the accot not appearing the sd Dent made Oath upon the holy Evangelists

that according to his Decl his accot was just & due. The Original Writt agt sd Whaples produced in Court returned

by Sheriff Capi Sed fugit which by this Court being Considered it was then Ordered by sd Court that the Sheriff

be amerced for his false return according to Law & that he the sd Sher produce his prisoner next Court or pay the Debt

declared for being allready proved /        Memorand mr Ja. Dashiell sate Prsdnt.

                                                      The Courts adjourned till the Second Tuesday in September 1694 /
