( 121 ) To the damage of the Said William of 1200 pounds of Porke & thereon he brings his Sute Dent pr Quer Pleg &ca Jno Doe Rich Roe } This Bill bindeth me Archibald Holmes of Somerset County Cooper my Heirs Extors &Admrs to pay and deliver unto Wm:Anderson of Acamack County at or before the fifteenth day of November next at the sd Andersons house the just quantity of Six hundred Seventy Six pounds of good & Scalded Porke Two hundred twenty & Six of which is for ye propper accot of John Hincks. Coll David: Browne Plt Somerset County Ss Peter Whaples late of Somerset County Shoemaker was attached Peter. Whaples. Defendt } to answer unto Coll. David Browne in a Plea of Debt &ca. ~ ~ ~ ~ ~ ~ ~ ~ ~ And whereupon the sd Coll. David Browne by Robert Pirrie his Attorney complaineth That whereas the Said Peter the 29th. day of August in the year of our Lord 1688. at Monokin within the Jurisdiction of this Court by a Certain Instrument of writeing or Bond with Condicon which the said Coll. David Browne under the hand and Seal of the Said Peter bringeth here into Court, the date whereof is the day and year aforesd acknowledge himself to be bound to the sd Coll. David Browne in the full & just Sum of Six hundred fifty & Six pounds of good Sound mertable Tobacco, to be paid to the Said Coll. David Browne as recourse being had to the said Bill or bond with a Condition more at more largely & fully it may & doth appear Neverthelesse the Said Peter the Sd Sum of Six hundred fifty Six pounds of tob. as aforesd according to the tenour of the aforesd instrument or writeing to the sd David Browne he hath not paid although the Said Peter to doe the Same by the sd Coll. David Browne hath been requested but hath hitherto refused & doth Still refuse to the damage of the Said Coll David Browne of 656 Pounds of tob. & thereupon he brings this Sute &ca.. Jno.Doe Rich:Roe } Maryland Ss // Know all Men by these presents that I Peter Whaples Shoemaker of Somerset County am holden & firmly bound unto David.Browne of the Said County in the full & just quantity of Six hundred fifty & Six pounds of good Sound Merchantable leaf tobacco in Caske to Containe the Same to be paid unto the Said David Browne his Heirs Extors Admrs or Assigns convenient in Some Towne in Somerset County to the which payment well & truely to be made I bind my Self Heirs Extors & Admrs firmly by these presents. In Witness whereof I have hereunto Sett my hand & Seal this 29th. day of August ano Domini 1688 —
The Condition of the above Obligation is Such that if ye above bound Peter Whaples Shoemaker Shall well & truely pay or Cause to be paid unto the abovesd David Browne, his Heirs Extors or Admrs or Assigns the just quantity of three hundred twenty and eight pounds of good Sound Merchantable leaf tobacco in Cask to Contain ye Same at a Convenient Towne as aforesd then this present Obligation to be void & of no effect otherwise to Stand remain & be in full force power & vertue. Sealed Signed & delivered in ye prsence of us Peter Whaples ❂ Sealed Charles K Kinsey his marke Margret Ereskin. Saml. Worthington confest judgmt for 328 lb tob. being Attorney for the Dft.
